In April I broke my ankle very badly,so badly that at one stage it looked possible that my foot may have to be amputated. Thankfully I still have my foot and am now on the mend. While in hospital I missed my capital one credit card payment,and they were ringing me 4/5 times a day,a different person each time,asking how long I would be in hospital and when I could pay them! Even the doctors at the time didn't know how long I would be there! After 6 weeks I was discharged.......then the fun started. I rang capital one and as I wasn't working due to my injuries they agreed to accept a £15 per week payment over the phone via debit card every friday. I work for myself and I am only getting sickness benefit £15 is a lot of money at the minute,however i have paid every week without fail. I have also received letters/phone calls from capital one(a different department)telling me that I had refused their offers of help and they were taking me to court to recover their money! I advised them to check my payment recordd and they had to admit that I was paying £60 per month,no apology for the threatening phone calls or letters,they just put the phone down! Now they are sending me bills which clearly show I am making a £15 payment every friday,and on the same bill is a late payment charge! How the hell can my payment be late if I am paying weekly?

Any advice on how to deal with them would be most welcome.

    The first bit I dont know about, you may want to visit your CAB about that, particularly if they are threatening court action.
    As to the late payment fee's - have they at any point said they would waive the fees? They may be allowing you to pay £60/month without taking further action (although it seems they have cocked this up from first part) - however you are still not meeting your contractual minimum payments thus resulting in late fee's.
    Your payments arent late, they just arent enough to cover minimum.

    I would either (or both) ring them up and speak to a manager - ask for the department that deals with assisting(?! I use this term loosely) customers in financial difficulty, or visit your CAB
  • Since they found out I was in actual fact paying them I have heard not one thing about any court action. I think the department were embarrassed because they seemed to genuinely believe I wasn't paying them a penny when in actual fact I was paying £60 a month. I still think I should have least had a 'sorry' out of them over their !!!! up,but they just put the phone down at their end. If they did try to take me to court surely it would be they who ended up looking silly given that I can produce bank statements with debit card transactions showing on it for the same amount every week?

    If I was paying the minimum 5% of outstanding balance payment once a month,it would be slightly less than £60,so in effect I am paying enough(or so I think)despite missing a payment while in hospital. I can't help thinking capital one have got their sums mixed up here somewhere. :confused:

    If your just paying the minimum then, are you still a months payment in arrears from when you were hospitalised?

    If you are this would account for the fee's. What does your minimum payment say on your last statement?

    I have come across similar, and the credit card company was actually very helpful and agreed to waive one payment without fees, nor an adverse credit mark, on the understanding that it was a one-off and would not be allowed again. Never thought I would say this, but Jamal is spot on, try and talk to a Manager and see what they can do to help. I have also found that writing can be more effective than phoning, and if you also mention the 'distressing harrassment' and onvious service failures, it might work in your favour.
    I hope they called you on a patientline number at 49p a minute!

    Totally agree - I mean, sponsoring Nottingham Forest!:rotfl:
    When I had debt, they were one of the better Companies to deal with, but in reality it sounds like pot luck. Some friends found Barclaycard helpful, whereas I found them to be pretty awful.

    Think a lot of it depends on who your lucky/unlucky enough to get through to on other end, what kind of day they've had, if the wife put pickle by mistake on their butties etc.
