takeawayaddict - I did misunderstand your post if that was what was meant, therefore I do apologise for the accusation unreservedly, but "Apology accepted when you provide it." maybe post in clearer terms may help ;P

stevemLS - put that way I do understand I did maybe take it the wrong way :)

loskie, thanks but I didn't think the Health and Safety Executive would be interested in one single case, although probably if a union rep was available they would relish in it.

The accident book was filled in, there has been loss of earnings (again we survive so that's not the main criteria), the new process is pretty much a usual management fudge.

I suppose what I'm asking is - is there a way outside of the ambulance chasers to handle this or do they hold the !?!?

I just don't want this to keep on happening.

Again thanks in advance for any advice.

    What to not keep happening?

I thought they had a new policy at work now?

HSE is interested more in general problems, not one person.

The new policy is much of a 'take more care' (like you shouldn't have done previously), just a paper exercise so that management are covered by doing 'something'.
  • So you're OH has slipped on something that had been dropped in a canteen. She's in pain and losing wages?

    What is it you want?

    Justice?

She can indeed take them to small claims court without using an 'ambulance chaser' - the company must have employee insurance against such claims. And the quantifiable claim she will have is loss of earnings which is why it is relevant.
But a banker, engaged at enormous expense,
Had the whole of their cash in his care.

At last:T The company will have Employee Liability Insurance to cover such an eventuality, that is what any claim should be made against. Why people think they always have to go via a claims solicitor I'll never understand.

But you would still need a legal process (and a solicitor) to determine negligence or otherwise.

Only if the insurers dispute the claim submitted.

I skim read the thread and mistakenly had in my mind you were the OP.

I had a little laugh at your username when imagining how appropriate it was for the OP's situation and I was hoping they did not slip on the latter part of your username...
