So did you put your real address on your application, or did you commit fraud?

    As for Mis-sold :rotfl::rotfl::rotfl::rotfl::rotfl:

Would it not be more suitable then for me to just return to the UK and claim bankruptcy as I cannot afford to pay the amount they want and I am not interested in my credit record in UK.

If you are never returning to the UK why bother?

In any CC application you will need to declare that you are a UK resident. If you applied a creditcard in the UK using UK address while in fact you are not living here anymore you are committing fraud.

Someone who try to find a loophole to get away with fraud here in the UK should not get any symphaty. More seriously try twist the fact by put blame on the Banks ....

Hopefully the OP will get chased by Debt Colletors ..

Keep in Mind the debt collecters have an international network which could still chase you even you are living abroad ...

I checked randomly Barclaycard, and I don't see any direct declaration, at least on the first page of application. It would be odd to leave this declaration to the next pages.

You will need to declare any change of circumstances which impact your ability to pay back.
I checked randomly Barclaycard T&C and have not found anything that can substantiate your statement.

"Laura Howard of MoneySupermarket replies: It’s impossible to open a current account or get a credit card from a UK bank or building society if you don’t have a permanent address within its shores. The main reason for this is that lenders are unable to carry out credit checks on you, so it can’t assess how reliable you are as a borrower"

I remember anytime I open a current AC or apply a credit I have been asked to confirm that I am a UK resident .....

It is easy to understand if they allow a non UK resident to apply for a Creditcard. Any fraudster, International students who used to live in the UK could get a creditcard ????....

OK, can we agree that not "in any CC application you will need to declare..."?

MBNA reject application straight away if you answer "No" to the question "Are you a UK resident?". Barclaycard don't.

No, any fraudster with a UK address that he can prove, that isn't necessarily the same as being a resident.
Also, it has to be the address where he can receive the card, not just where he "used to live".

Generally, 'resident' is a very vague term that can have different definitions for different purposes.

I'd argue it means tax resident, or intending to become one.

Technically last year, I was tax resident in two countries though (UK and Russia), so that may muddle things further.

Last year, I'd say I spent the most time in Russia, but this year will be different still. My bank in both countries are aware of my situation and happy with it, and any further questions I'm happy to answer to them.

There has to be something in place for a situation like mine, but what it is, I don't know, as they're products I already hold (which banks are generally happier with than not).

What does a CC have to do with taxes?
If it means what you say it can clearly say so. "Tax" is a very short word.

I would disagree. Even within tax, there are different definitions. Resident, ordnarily resident, domicile etc. Also tax authorities tend to work on a tax year, so can take the view that you are resident for a particular year, even though your residency has stopped.

I think if it came to a legal "ballyhoo", a judge would just look to give the words their natural meaning in the context of the application.

BTW, for many years I was in a similar position as you, often spending more time out of the UK than in, sometimes resident in the UK for tax purposes, sometimes not. Generally I had no problems maintaining accounts in the UK. I did phone a couple of CCs at the time to see if they could send paper statements abroad. No, they said. But whilst I had a postal address in the UK able to receive mail, they didn't seem too bothered about where I lived - despite any requirement in the T+Cs to be UK resident whilst running the account. I didn't open any fresh accounts whilst flying around, though.
