Girlfriend has parking ticket

Hi my girlfriend has received a claim form from Parking Eye. We are unsure what happens next. The car park was free and our overstay was for 30 mins. The fine has now gone up to 160 that include court and solicitor fees.

Silly question, but do we have to pay it? if not what do we do next? i have had a little look through the forums but this has made me more confused.

Thanks

It's not a fine, it's an invoice. Do not pay, do not ignore, do not reveal who was driving.

Read the Sticky thread for NEWBIES then appeal once you have the notice to keeper/owner. Do not appeal a windscreen ticket unless the vehicle was a hire/lease car. This advice only applies to England and Wales.

Read the Newbies thread, near the top of this forum, post #5 about PE claims.

Parking Prankster - Google him - read his info about 'how to defend a Parking Eye claim'.

'ParkingEye v Beavis' case decision - Google it and also search here; read about it on the Prankster's blog.

If you don't do the above you'll lose. You could try an offer of £50 marked 'without prejudice' but you MUST also acknowledge and defend the claim, or you lose.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

You need to be a bit more specific about what you have received.

Is this a County Court Claim Form - issued via MCOL?

    It just says 'Claim Form'

    Claimant details,
    Defendant details
    Particulars of claim
    Disclaimer signed by a solicitor

Address on letter is County Court Business Centre

Thats the info on letters, it also states i can respond to the claim online (https://www.moneyclaim.gov.uk)

    Thanks

We are unsure what happens next.

You need to get a grip on this, you could end up being refused a mortgage, it is that serious. You need to do a lot of reading including Parking Pranksters advice on dealing with PE in court.

I'm feeling that we are missing a fair part of the story here.

Unless I am much mistaken the County Court claim cannot be the first communication from them.

Surely your girlfriend has naievely ignored or possibly not received previous correspondence.

Either way she needs to act now by following the advice already given.

As The Deep has said there are some serious repercussions possible if this is not handled quickly and correctly.

She must READ the claim form, she has to Decide if she is going to pay or go to court.
    That is her choices.
Doing nothing will result in a County Court Judgment against her name.

She has can fight the claim in court with a good defence and many do, if she loses she can pay the judgement within 14 days and a CCJ is not registered against her.

She might be well advised also learn to recognise Parking Eyes signs and not using any car park or business that uses them or she may well get more of these, the risks are not worth the chance, shop elsewhere !
Any company that will allow them to operate are making it very clear in my opinion that they do not want your custom.
