Hi,
My query is regarding the loan I took out with Northern Rock in July 2006.
After reading all the bad press regarding PPI I shopped around to find stand alone cover for a tenth of the price!(Thanks Martin).So,yesterday I phoned N/Rock to cancel the PPI.The girl advised me not to cancel as it would mean a new agreement which would take half an hour to process.Then she said as the loan is front loaded I was aswell keeping the agreement going as the actual loan hasnt started to be paid off yet.But it clearly states on my loan agreement in the monthly breakdown that £35.61 is towards Loanguard,£115.36 is the cash loan,giving a monthly payment of £150.97.
Do I have grounds for a refund on my PPI?

i have been told today that as the case has to be decided if it will go ahead, it is now in a smaller "fast track" queue. it should be a matter of weeks if the decision is made to go ahead or not. Do i complain to the FOS and if so about what? sorry, im blonde and just not grasping this!
I thought i would just have to wait and see if the FOS are prepared to take on my case with ltsb pushing that they shouldnt.0 -
sorry, and the 2 weeks is after/if fos decide to take on the case. this as you say will take considerably longer.0

As i said ltsb can't raise it as a case with the fos only you can. so do so now and let ltsb know.0 -
some confusion. I have raisd my complaint with the fos and they have started to gain evidence by charging them the claim fee and requesting my documents. ltsb have raised an objection to the fos dealing with the claim as they believe i am outside of the 6 year time frame so they have told the fos they would like to contest them taking on the case. all seems a little unfair to me but now have to wait for a decision off the fos as to whether or not they will take on the claim i submitted back in dec. ltsb have basically told me only if the fos will fight them, they wiill settle.
if the fos will not take the case on can i still go down the court route?
sorry my head is mashed with this now, seems to have been 2 stamps for everyone else!0 -
will that be verbal or written somewhere you can tell me im a pain in the posterior if you want i know i keep asking loads!!!!

yes you can still go down the court route at any time but you have to let the fos know when you start the court case.0 -
Im more confused. Surely its the decision of the FOS as to whether or not they will take on the case?? I'd love to take control, but feel like its out of my hands now and in the hands of the FOS. To make it worse LTSB have told me if it goes to the FOS they will settle in 2 weeks!! Can you please tell me what else I can do??
By the way, all of the help you give on here is fantastic!!

Thanks, i think my case seem sto be slighly more complex and ltsb are fighting it all the way. I will wait and see what the fos come back with and then decide if i should risk going to court, losing and being liable for a load more costs!
If the FOS take it on, LTSB have told me they will have no option but to settle ( thus proving I have a case ) but they are hoping the FOS won't take it on due to timeframes so they dont have to pay up. The perogative of one of the largest loan sharks in the uk i guess.
Thanks for all of your advice anyway, i just find it strange that no-one else has mentioned this in any other thread!! making me think is what they are doing allowed, or at least a normal course of action.0
