    Thanks guys! I will start the process of getting an SAR sent off.
    Don't relish the thought of court but I suppose the old saying is, nothing ventured, nothing gained and I can show that insurance has served no purpose as I needed to make a claim in 2003 and was declined after a telephone call but told I had to keep the insurance!...
    Hi there, there is nothing to be scared of about taking a claim to court, you've just got to know the law / case law of the claim you're making - if you're unsure do as Martin suggests and consult a solicitor or claims management company.

    I have received a letter from LloydsTSB Insurance to inform me that they disagree that I have been mis-sold PPI with my loan of 7 years (the insurance element has cost me £4,000 plus interest). I believe that I have been mis-sold as I had a pre-existing medical condition. The sales person never mentioned any existing medical conditions, but they say that as they sent the policy booklet and as I signed an acknowledgment and returned it, it also shows the costs per month of the insurance and therefore they say that it was not mis-sold. Has anyone had such a letter to then go on to have a successful outcome, or you think this is the end of the line for me?

    Does it mean that because the salesperson didnt mention it and I subsequently signed the document mean it hasnt been mis-sold.

    I really would appreciate some feedback from anyone

    they're trying it on - ask for a copy of the sale persons financial background, formal training etc at the time the policy was sold, under the law regarding negligent mis representation the onus is upon them to prove they didn't misrepresent the details of the policy.

    Just a quick question to the forum. I have been sending all of my complaints about ppi via email rather than traditional letter. Can the ombudsman look at my case now, (over eight weeks have past since the first email) or will I have to send an actual letter to First Plus and wait another eight weeks?

    I've given them until tomorrow to respond to my second email. They basically told me where to go in response to the first. Cant wait for the postman to come. (for a change!!!)

  • question. I was missold a PPI on a car finance 3 years ago due to there being no option to opt out and was told by sales assistant had to take it or couldnt get the car. However, now in position where I am going to have to surrender the car. with only 9 months payments outstanding, I still suspect the full debt will be written off (despite the car being valued £1000 under the amount outstanding). The PPI I am due back will be about the same as the shortfall. Can they keep this amount if I apply now and put against the loan or should i wait for a while before reclaiming to make sure the debt is written off, it would just help pay of other outstanding loans quickly.

  • I currantly have loans with no PPI but my old loans which I had did, I have took out loans to cover old agreements and get more money like my currant one therefore having to pay off my old loan with a new one (consilidation) which I assume ment paying off the old loan plus any PPI sold with it.
    I never claimed on the PPI so would I be able to claim the PPI back??

  • I received my "Final Response" from GE Money this morning stating that my complaint has reached "deadlock" and I should refer all further complaints to the broker who set up the ;oan and PPI "Creditlink".

    They also said I should have received documentation stating the 5 year plan, I have no recollection nor do I recall ever receiving this document.

    Where do I go from here, I have escalated my complaint to the Financial Ombudsman do I await their ruling or do I chase Citylink?

    Either way I think I am chasing a lost cause here :(

    email is still 'in writing' if you've got a final response and First Plus came under the jurisdiction of the Financial Ombudsman when you were sold the PPI you can take your complaint to them.

    Hi you should always take your complaint to the people who originally 'sold' you the PPI as apposed to the lender - also you can only take your complaint to the Financial Ombudsman if GE or Creditlink came under their jurisdiction at the time the policy was taken out
