  • I'd forgotten about The Associates! My first experience in borrowing and it was a nightmare - changed my mind the day after I signed for a loan and they refused to cancel the agreement. Also, to lessen the outgoings, I cancelled PPI by a hand-delivered letter to their office on Hanover Street in Edinburgh (memory still fresh on that point!) and they continued to apply PPI cover for the next year denying that they'd ever received such a letter. To top it all off, the woman in the office I spoke to called me a 'silly cow'. The more I think about it, the more angry I am now. Think I may just write to Citi-financial about that and wish them a Merry !!!!!!!' Xmas!

    Anyhow, I digress, on the PPI front I've looked back over my credit agreement with Sainsburys for a credit card that was taken out in 2002. The box for 1 year of PPI cover was ticked, yet they charged me for the next 5 years (perhaps my fault for not cancelling?). Anyhow, I've asked for all the premiums to be refunded after the expiry of the inital 12 months worth of cover. I thought that quite a fair way to resolve it.
    Almost debt-free, but certainly even with the Banks!

    I am currently in a dispute with First Plus regarding my ppi reclaiming. I have a single premium policy taken out in August 2005. Whilst reading through Martin's article on ppi reclaiming, I noticed a sentence saying that any policy taken out after May 2005 has to have additional paperwork completed for the ppi, separate to the loan paperwork. Can anyone shed any light on this statement. My policy was started in August 2005 and I only signed in one place on the agreement form. This was one signature for both loan and ppi together. The two amounts are clearly shown on the paperwork, but I only signed once. Does this mean that I should have signed a completely seperate agreement for the ppi, or does this statement just mean that the two parts of the total amount borrowed have to be shown seperately on the agreement, which they were.
    Basically, as I only signed once, does this help in my case against First Plus?

    Can anyone please advise regarding how long I should give in my letter for First Plus to respond? We settled the loan in full last year after only having it for 9mths and the partial refund we received was woeful. Drafted a letter quoting the FSA ruling and asking for them to recalculate my rebate plus 8% statutory interest, and said want a reply within 14 days. Is this too short or should I give them longer to respond? Any thoughts on this would be much appreciated. Thanks!

    Would anyone be able to help me with this one?

    My dad took out a loan with Lloyds in 1993. He was self employed at the time as a contractor for a housing company, and was basically told that he could not have the loan without PPI which would cover him for medical purposes and out of work.

    Obviously being self employed, he was missold. However, 2 years later he was on the books. He's now been written off work as disabled (soratic arthritis, new joints needed).

    Anyway, he tried to use this PPI, and after 6 months, Lloyds have declined this insurance based on the fact he should have told them when he was diagnosed with arthritis. He didnt, he just carried on working for 3 years until he no longer could.

    He has refinanced this loan since 1993 twice, basically just differing amounts, and has NEVER been given any more PPI forms to fill in, just a pen and paper in a Lloyds branch itself, and then simply handed the new cash (hes very old fashioned that way!).

    He has paid roughly £30 per month since 1993 to be told he's not covered as HE should have told them 3 years ago that he had been diagnosed with arthritis. Apparently all in the agreement.

    I have a copy of the refusal letter, but actually, this could work in his favour.

    He has spent around £6000 on loan protection since 1993 - now. His loan stands at £4000.

    Doe's he have a claim? Basics:

    - was self employed when loan taken, was told he couldnt have it without protection, now that he's been written off work, PPI refused by Lloyds based on fact he should have told them about this diagnosis 3 years ago, even though he was never, at any point, asked. Think they are basing it on the fact that 2 years ago, he asked for another 2k, signed the papers, but was 3 years ago that the diagnosis was made. So re-financed after diagnosis. But like he said, he was never asked, otherwise would have said, he had nothing to hide as he was still working anyway.

  • Hi all, just thought I would let you all know that one of my credittors, Marbles, have rung today to say that following my letter last week advising them I had complained to the Financial Ombudsman as they hadn't responded to my request to look at my claim, advising me that they have sent a letter offering a full refund for my premiums paid. Its only £213,but its better in my pocket than theirs.
    Just shows that if you follow the advice on the site and send the letters out and don't take their first inevitable no for an answer, it really does work in our favour.

  • Hi, hope you all had a good xmas! Just want some opinions on a letter i am sending to firstplus after they basically told me to bog off! (have pinched a few lines from gt568 which i liked the sound of!)

    "Dear ******
    I am writing in response to your letter dated 13/12/07.
    I have considered your response and remain dissatisfied with your decision so I am again requesting a full refund .
    When I took out the loan I was in dire financial difficulties and believed I would not receive the loan if I did not take out the ppi. I also believed that the cover was for the full term of the loan and was not aware that it would end after 5 years but I would still be paying interest on this extra amount.
    Firstplus also made no attempt to ascertain if the product it was so willing to sell me was fit for purpose, suitable for my needs or if indeed needed at all.No medical questions were asked or enquiries made about pre existing illness.
    I believe insurance contracts are “contracts of the utmost good faith” which imposes on you a “Duty of Disclosure of all material facts because one party is in a strong position to know the truth”. Therefore I believe it should have been disclosed to me that the ppi sold to me essentially made me borrow more money rather than simply pay a monthly fee for insurance. I believe it should have been made clear to me that the policy generated large profits for firstplus at my expense. You failed to do this ,so I believe you have failed in your “Duty of Disclosure”. Your failure to disclose is misrepresentation at common law.
    I would again bring your attention to the FSA ruling on single premium policies which deemed them to be unfair.
    You also claim to have spoken to both my husband and myself on 11/02/2004 so would therefore request a copy tape of this conversation as I have no recollection of this.
    I have no desire to “escalate this internally” as my understanding is that you are unable to uphold my complaint. Please let me know if I have misunderstood!
    If I have not received a response from you within 14 days I shall be forwarding my complaint to the FOS.
