I have a ticket from Care Parking issued at the Metro link car park which I understand from other threads is not relevant land as its covered by by-laws, Care are claiming liability under pofa 2012.
As per the other threads I have complained to the DVLA about handing out my data and they have sent this reply....

Regulation 27 of the Road Vehicles (Registration and Licensing) Regulations 2002 provides for the release of information to the police, to local authorities for purposes connected with the investigation of an offence or decriminalised parking contravention, and to anyone who can demonstrate ‘reasonable cause’ to have it.
DVLA considers that for landowners, or their agents, to take action against vehicles that contravene parking restrictions, trespass on private land or for the removal of vehicles abandoned on their land is reasonable cause to release information.
DVLA does not and cannot regulate any aspect of a company’s business. Therefore, it has no influence over the length of time keepers are allowed to park or any aspect of the tickets issued. This is a matter between the land owner and the company it employs to manage the car park. These and any other representations should be made to the company.
DVLA’s interest in relation to any company’s set up is in the context of ensuring that we meet our duty to ensure that we are aware of who information is being released to, for what reason, and how that information will be used. Information may then be disclosed under the ‘reasonable cause’ provisions.
Whilst seeking to ensure that vehicle keeper data is released only in appropriate circumstances it is not a matter for the agency to decide on the merits of individual cases or to arbitrate in any civil disputes between two parties.
DVLA would be concerned if information were to be used for a purpose other than that it was requested for. If this were to occur, DVLA would ask the Information Commissioner to investigate the matter.

I told them they should not have handed out my data as the land is covered under by-law and that they are already aware of that, the reply is clearly a template fob off, what do I do next?

You are right of course but the main job for you is to lookup the many successful appeals against Care Parking at Metro Link and get this charge cancelled.
For DVLA this is just a very nice income stream and however wrong it maybe I can't see them changing their modus operandi.REVENGE IS A DISH BETTER SERVED COLD0 -
Escalate. DVLA has in the past suspended companies from data access for claiming keeper liability where it doesn't exist. Insist they do so here.

To trace the keepers of vehicles that have been parked on private land without paying the parking charges.

AS the DVLA have written "DVLA would be concerned if information were to be used for a purpose other than that it was requested for. If this were to occur, DVLA would ask the Information Commissioner to investigate the matter.", I would inform them that they have now been informed that this did occur and that, in accordance with their letter, you expect them to inform the Information Commissioner and, under freedom of information act, you would like a copy of that letter.
That should cause them to reply with a non-template letter at least!0 -
I emailed them back asking for a response that is not a template so will see what they have to say about that.
I also pointed out that they are aware that they should not be giving out information as by-laws are in place on this site and that they are already aware of that, I asked them to esculate my complaint.
I also appealed to Care Parking but they have ignored it and gone straight to debt collection so I have some colourful letters from Debt Recovery Plus.0 -

Did either Care or the debt collectors provide you with a POPLA code?
If not more complaints needed to Care and the BPA0 -
Not given a popla code for either despite sending an appeal for both, they ignored them and went straight for debt collection.
I have complained to Steve Clarke at the BPA and had two replies, the first saying send them a copy of the ntk, appeal and proof of postage which I haven't done yet, the second saying theyre contacting Care Parking to see what they have to say.0
