re DMG (UKPC) POPLA

So, some of you may know I am having to fight 2 tickets from ukpc.

I have had, like some others, had a evidence pack from ukpc quoting the Beavis Result and I wondered how best to reply.

I have rebutted the usual points - signs etc, its the Beavis commentary and response - should i simply state it as this is a private car park the beavis result doesnt apply?

    Its a private residential car park, with a permit.

    Is the permit requirement stated in the lease? (This is why new threads for the same topic are not advised - the same questions need to be asked over and over and over again).

    Parking prankster has said very little about any change of advice post beavis COA ruling. merely stating some of his advice may be out of date.. Parking cowboys website have gone further and mentioned, that GPEOL may no longer be a viable appeal point. ( which i would geuss still leaves plenty of other points to appeal on)

    there is no mention of parking in the lease, but the car park, signs and landlady have said we needed one.

    Oh ok will check out parking cowboys, I had previously argued the GPEOL.

    I have started building a portfolio of links to websites and to gain information, in preperation for my own upcoming popla case ( also with UKPC)

    The "commercial justification" in the beavis case was founded on some specific factors associated with turnover of traffic in a car parking serving shops, these factors won't apply in a residential car park.

    In order for parking to be implemented it must be in line with the terms of the lease - that's not to say it must be in the lease terms and conditions, but an ammendment or addition to the terms and conditions of the lease must be permissible. Even if amendments are permissible (they often are), there may be caveats to how far these amendments go or limitations to what the management company or landowner can do.

    I based part of my UKPC POPLA appeal on the parking enforced not not being permissible under the terms of the lease. UKPC didn't even bother to submit evidence!

    I also wondered if anyone has steve clarks email as I am pretty sure I have proof of UKPC trying to fraudulently provide ticket charges to another person!

    (Admittedly it was before Christmas but fraud is fraud right?!)
