Medical Termination Payout & Deductions

Hi all

This is driving me mad. I do PA work for a disabled lady who has been let go with a decent payout for the years she worked. However, payroll messed up earlier in the year so she has lost a chunk to pay that back.

They have also made a sickness adjustment on the grounds that all sickness adjustments are made in the month following the sickness period.

The issue is whether they can deduct this from her holiday pay in lieu...

We sought advice last week from the local law uni's clinic. The 3rd year student and his supervisor both agreed this is an unlawful deduction of wages. We are beyond the limitation for Tribunal now and they have advised us how to proceed with letters then Court.

However, I am unable to find any case studies or point in law to back this up for the first letter. The law student didn't provide any, grrr.

HELP PLEASE! I need to get the first letter done.
