Parking outside authorised parking bay PCN from 14 Services

Hello all,

Last Thursday I received a PCN from 14 Services through the post for failing to park in an authorised parking bay when I stayed at my friends house overnight in Cheltenham on the 18th April. The car park is private and had a gate that opens when you enter and is managed by said company. When I parked my car, her allocated parking space was taken by another vehicle and there were no visitor spaces available so I parked my car in an unobstructive position in the car park so it did not block the exit or any other car park users. I also wrote a note and left this on the dashboard in case anyone came and checked overnight.

I have since received the notice of £100 fine or £60 for parking here (which was done by an ANPR camera and not a human) if I pay in 14 days but don't know whether to appeal this because I admit I was not parked in an authorised bay but couldn't park in her allocated space because someone else who we couldn't find was parked in her space. It states that if I appeal I cannot repay the reduced rate but don't know if I have a case as I am technically in the wrong.

Thanks for your help, I have tried to seek advice from other places but to no avail.

    Start by reading the Newbies Sticky at the top of this forum - it outlines all your options for seeing this off. Concentrate on the IPC section for your ultimate appeal, not BPA/POPLA

    A quick look at their website throws-up this humdinger:
    We are LEGALLY authorised under law to issue Parking Charge Notices (Parking Tickets) on areas of land that are PRIVATELY owned, ie: Land that does not come under the jurisdiction of the Highways Act.

    its deffo not a fine, its a parking charge invoice, wont have the word "fine" anywhere on the paperwork

    these are an IPC member, who use the kangaroo court known as the IAS for appeals

    you should send 14 SERVICES the template letter from the newbies sticky thread (I dont think you hav read it yet) and appeal it anyway, as registered keeper, on the grounds of no loss , poor signage , no landowner contract etc (the usual)

    you also need to check the wording on the signage as well as on the paperwork, for compliance

    also check if the postal notice came within the required time (depending if you received a windscreen ticket or not)

    if no windscreen ticket was issued, they had 14 days to send the postal notice, if not then they cannot use POFA 2012 against the keeper (so no admitting who was driving)

    I suggest you amend post #1 and take out any of the personal details asap, dont assume parking companies cannot read forums, they can and do

    ANPR cameras dont enforce parking bays etc, they record the IN and OUT times
