  • Yes, VAT's a kicker, they rarely include it in their figures, be aware your solicitor will also likely charge +VAT.

    Fees of 1.25% plus vat which makes an extra grand for me to find.

    And what did they write on your contract?

    If they do not specify VAT separately then the price is inclusive.
  • I found it in the small print, but I missed it at the time. It's not that which is an issue, I accept that bit, my fault entirely I'd suck it up if it wasn't for the other stuff. I just don't trust them at all now.

    Guess I'll just have to see what happens.

    Appreciate all your advice though.

    I'd be tempted to send in a friend with a tape recorder. You need to find out exactly what they are telling potential buyers:

    * "the seller has received an offer of the asking price and is happy with it. That buyer is confirming their finance" that would be professionally correct, and would 'put off' many buyers

    * " the house has been sold" or "the seller is no longer accepting viewings" or similar is clearly breach of contract and you should write saying so and terminate the contract with the EA immediately. Make clear you beleive their breach invalidates the need for the 12 week period. Sign up a new agent.
  • Hi there - do you have any update if the lady's whos put the offer in has got anywhere with finance? If she's offered full value, then to be honest, I think you're being a little mean spirited not accepting her offer in good faith, until she's had sufficient time to put her finance in place.

    I'd like to think that's what we'd be saying if the lady who's made the asking price offer was in this situation asking for advice on here.
  • Not heard anything even though I've chased agent several times. They just keep saying she's sorting it. Of course now I don't trust them it has changed things. But I've had no formal offers in writing over a week after the agents told me of her offer. Maybe she changed her mind.

    I agree with G_M. But if you don't want to do the whole tape recorder/email thing then just complain in writing, wait and ditch them at the first opportunity.

    Until this first offer is proceedable it should change nothing at all. It sounds like the EAs are protecting the buyer for some reason.
