UKCPS Valley Centertainmnet

Hi,

I received a window PCN at 14:42 on 3/5/15 whilst visiting the Cineworld cinema in Valley Centertainment in Sheffield. The car was temporarily parked in a disabled bay in front of the Cineworld cinema as my son who is on crutches (if required I can provide proof of this) was being dropped off to see a film (Fast and Furious 7 at 14:40). I needed to enter the cinema with him so that tickets for the film could be collected (I have a receipt for the cinema ticket and the time of printing is shown as 2:41 pm). After ensuring that the tickets had been collected I returned to the car and to my dismay a parking ticket had been placed on the windscreen (£100 fine reduced to £60 if paid within 14 days).

After seeing the ticket on my car I went to speak to the Manger of Cineworld but was told that it was nothing to do with them and was directed towards the hut that the parking attendants are based in.

I have tried to read through the newbie threads and have noticed that UKCPS are now with IPC and so appeals are dealt with by IAS. However as ever all situations are slightly different and I just wanted some advice about how to proceed.

    You need to complain to any one who can think of ..... was it really the manager ? complain to head office ......

    complain to the local press , your MP .....

    please re read the newbie thread a second / third time ...........

    The IPC have the worst appeals service in the know galaxy ....... the chances of winning are small.

    Opinion is a bit divided on how to deal with them ..... my suggestion is to do the appeals , for several reasons

    one being if IF IF it gets to court then you will be shown as being reasonable

    a second is it builds up the case against them .... come judgment day!


    The advice you will mostly get is do the appeals ..... and then ignore debt collector letters for up to 6 years ....


    unless you get a letter before court action or an actual court paper ....

    its no different than excel or vcs on similar car parks, which have been discussed dozens of times on here, so same advice as in this one

    the only caveat is that you can also try for a landowner cancellation too

    but all the info is in the NEWBIES sticky thread so the replies will always point you at it, plus at similar previous threads as there is nothing new about your situation and that car park has been discussed on here many times before, the only difference being they jumped ship som 7 months ago to the IPC

    If you want to make trouble, look into the v.a.t. position. A contractual charge such as the one they apply must carry vat. Have they accounted for it? If not read here:

    I have received the response below from Cineworld - this was after I had sent a message to their main office via their web-site. Should I try and take it further with them.

    Thank you for contacting Cineworld.

    I am sorry to hear that you incurred a parking fine when using the car park adjacent to our cinema on your recent visit to our Cineworld in Sheffield.

    I can advise that this car park is not owned or managed by Cineworld and we therefore have no control over the rules and regulations regarding parking there.

    In order to protect the welfare of our customers we monitor the behaviour of car parking companies that manage car parks situated adjacent to our cinemas. Where a car parking fine has occurred as a result of a failure to park in compliance with the car park rules on the part of the customer, we do not feel that it would be appropriate for us to intervene as this matter will need to be resolved between the car parking company issuing the fine and the customer who incurred the fine.

    I understand that at busy times the demand for parking spaces in this car park can exceed capacity, and I can appreciate that not being able to find a car parking space can be very frustrating. Despite this frustration we would not advise customers to park anywhere other than in a demarcated parking bay in order to avoid car parking fines. In the event that a customer has contacted us to notify us that they were unable to find a demarcated car parking space and therefore returned home without watching a film for which tickets had already been booked we will of course always be happy to offer to refund the ticket booking.

    Only to tell them that you, and all those you know, will never be using their shabby establishment ever again, or at least until they stop consorting (even if indirectly via the landowner) with such disreputable and unethical companies.
