PIP result..would you appeal?

Not intending to be a political rant but fact, on the day "Call me Dave" gets 5 yrs free rein, my mum got a brown envelope from the DWP. From DLA HRC & HRM, she is moved to PIP standard care and mobility...OMG it's a miracle she can walk! Ok sarky over. Cold truth, £62 pw and car tax worse off with my father her carer, on the verge of another, his third to my knowledge, breakdown. She scored 10 in both catergories but, given how horrendous she found the assessment, this was a "pleasant " surprise. But....would you appeal? If she'd been turned down full stop it would be easier, as nothing to lose..this midpoint makes it trickier. So, no preaching just "what would you do".. Put up and shut up or appeal before IDS starts digging up graveyards and sending them to Capita.

    If her walking is not safe, reliable, and at half the speed of a non-disabled person, she cannot walk according to PIP.
    Could in principle she use a wheelchair?
    Has the father considered also claiming PIP if appropriate? (read above)

    You can phone up the DWP and ask for a copy of the assessment report, which can be very useful if you do decide to appeal.


    I assume that she would still have to request a mandatory reconsideration first, within a months timescale (assuming that the rules are the same)? In which case it's probably worth doing that anyway, as only involves phone calls not a full tribunal hearing - and you have to go through that before appealing anyway.


    The assessment report can make very interesting reading anyway, and may well help if she wants to have a MR or appeal.

    My Mandatory review had the same outcome as the initial award.


    I asked for all the paperwork that the decision was based on; I have never received it.


    I asked for a paper based Tribunal appeal, and was successful.


    I did not have any help at any stage when applying to the tribunal, apart from extremely helpful advice that RogerBlack had given to other MSE members.


    Read the decision letter again and again, and find just one thing to concentrate on that you totally disagree with. And keep your letter short and to the point.


    Forget your anger at the refusal of the award or the politics behind it.
    Just remember that your condition hasn`t changed; but the DWP goalpost have.


    I was called by the DWP before the tribunal sat. (They had been asked by the tribunal to attend, or at least give their reasons for refusal.)
    They said they had looked at my paperwork again and I would now have 12 points for Mobility; instead of zero.


    Not sure if I am now a brilliant goalkeeper or a ruthless striker!.

    Update, have shown them posts on here, reread the decision letter and there are 3 blatantly incorrectly recorded points, but of course we have no recorded proof, where she was awarded 0 but, we believe, should have scored 2. So MR it is but, one more favour please, as it is me who'll be typing it out etc, does anyone have a rough template for how to word it please. Obviously the main body will be specific but the niceties, layout etc. please feel free to PM me in confidence. It would be easy to say this added stress and worry is what has exacerbated my mums condition, and is why she has been totally incapacitated today but, truthfully, pure coincidence, it's just her everyday life.

    Congratulations jondoc, could you please email a copy of your written submissions as I don't know how to write it correctly, politely but firmly without letting emotions seep in.
