Hi,

Long time lurker on MSE and could do with some help/clarification from the collective :-)

I am trying to work out when to hand in my notice on a property which has a tenancy start date of 9th of the month.

 thanks for your help...

The simplest way would be to hand in notice on the 9th so that it expires on 8th of the following month.

I think that whether you have rights to get partial rent refund for other dates depends on the tenancy agreement but I'm not certain of your rights (and your LL might not be either), so the route of least possible hassle would be as above.

It's a minimum of one rental period of notice (since you pay your rent monthly) that you need to give. To be on the safe side you should serve your notice a couple of days early at least.

Send it first class a week before with notice ending on 8th.

You would need to have moved out by the end of the day on the 8th.

That could lead to arguments about the validity of the notice as the notice period would likely be too short.

Best to give notice a few days before the 9th of the month to expire on the 8th of the following month.

.... to clarify, would the notice if submitted by post (sent first class with proof of postage) need to land with the landlord on 9th (does it matter if it is a few days early to be on the safe side?

Apologies for the questions... never had to end rental agreement before!
1st class post is deemed delivered (served) 2 postal days later.

You can serve notice as early as you wish of course. The 'full tenancy period' requirement is a minimum and it is always prudent to have a few days in hand. If you wish you can give 3 months notice - it will still be valid!

    * Ending/renewing an AST: what happens when a fixed term ends? How can a LL or tenant end a tenancy? What is a periodic tenancy?
