Default on credit file from supposed CANCELLED contract

Hi guys, first post here as wasnt sure which route to take first, and didnt know how to correct this.
My boyfriend just tried to apply for a loan, with what we thought a perfect credit score, he got declined, so we decided to do an experian credit check to see what the problem was.

Turns out its a default from T-mobile/EE from a contract that had been upgraded in 2010, so the payments have been defaulting since then, even worse is the fact that he has had no letters, emails or any correspondence saying that money was owed, even though he still has the upgraded contract and uses it now!

He even has the letter confirming that the account was cancelled because even then in 2010 EE unlawfully took money for a contract that was no longer in use.

I did notice however that there was a settled account with the same dates, but had been settled in the same month that the default payments started, but they have his old address on file, could this be the cause of the problem?
who's to blame and can they take the default off his file?

At my wits end here and confused about what to do or who to speak to, has anyone else been in the same boat?
Many thanks
Lisa.

    Doesn't make sense
Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    I agree.

How is your boyfriend still using an account that was cancelled? And why?

Me too. Very confusing post. If the account was cancelled, there would be no bills.

My guess is that when he 'upgraded', he actually took out a new contract and the old one wasn't cancelled? Did he get a new number with this 'upgrade' OP? And where was this upgrade taken out?

EE have a track record of "upgrading" accounts across their networks by opening a new EE one and failing to cancel the old TM/Orange one.

You need to start by complaining to EE.

I wouldn't say this was the case. In my experience, it's usually dealers that do this because they get more comission for getting a new contract out of a customer thank they do for upgrading them!

I got a phone contract from Tesco on an o2 network.. I got the phone but decided I didn't want it so sent it back within a few days then obviously thought nothing more off it. I got a few bills for it but ignored them as I thought it was a mistake. Few year later I tried to get a Very account and was declined (I had no other debt at all) I wondered why so got an Equifax account and found o2 had defaulted me....

anyway I had to contact o2 and go through a lot of rubbish, a lot of the time the people didn't know how to help me and after a few months of emails and calls they finally got it removed from my file. If your default was a cause of theirs they will remove it but it'll take awhile

Yet another example of how these companies are out of control. They are effectively unregulated and use the threat of credit blacklisting to get their way and screw you over. It's high time
these companies were prevented from reporting customer accounts to the CRAs.
