Joint Income Support Claim & Childs DLA

Hi there,

Been on a few times over the last couple of months:) To those, who have given me some advice, thank you.

Looking to move in with my girlfriend the end of the month.

Going to be moving over from single income based ESA (employment support allowance) on support group, receiving IS10 (SDP Severe Disability Premium) have been living alone, and enhanced care/mobility PIP, to joint Income Support claim.

My girlfriend also receives single income based ESA, also on support group, receives IS10 as well, also been living alone, and middle care/high mobility dla, and is also coming on to joint Income Support Claim.

She also has a little boy, who gets middle care dla.

I'm undecided between the 2 following choices:

1) Joint Income Support Claim.
Where we both still get SDP, as we meet the criteria, me being on enhanced PIP, and Colette being on middle care DLA, and Colette gets £ 34.50 carers premium for Jack.


2) Joint Income Support Claim.
Where I claim CA carers allowance for Colette, and Colette claims CA carers allowance for Jack.

Would like some advice please, and also your calculations for both types of claim above. Thanks in advance for your help. Cheers.

    I do feel for you with all that illness in the household. Are you and Collette both fit to provide 35 hours of care for other people?

    You could try putting the two different scenarios into the benefit calculator on https://www.entitledto.co.uk

    However, this is very complicated because of the disability/carer's premiums and the 'rules'. You would be best served by going to CAB for a better off calculation (choose one with a benefits specialist)

    youd ne netter off stopping the carers allowance claim and receiving 2 x SDP instead. ( £61ish versus £35ish)

    It's swings and roundabouts.

    An IS claim is reliant on DLA or PIP being in payment at the correct rates, so any disruption in them may cause hardship, with appeals taking many months to process and not being eligible for IS at all durirng these periods.
    An ESA claim has a seperate round of assesssments on top of DLA or PIP.

    Would we not also be entitled to carer's premium of £34.60 each, as we will get sdp couples £122.20, cos we meet the pip/dla criteria.

    sorry .... didn't realise the carer claim was for the child.
    you will only get 1 carers premium as only 1 is claiming carers allowance

    For the SDP you cannot have someone claiming CA for you.

    Personally I think you would be better off if partner claims only for child and then your partner doesn't lose the SDP but it is complicated as it is a joint claim.

    the carers allowance is being claimed for the child, thats why 2 x SDP is payable.

    The OP says he is claiming CA for his partner therefore she won't be entitled to SDP.
