    If this had been a DWP or Pension Service overpayment, I can assure you that they would be hounding the family or executors to repay.

    Why should it be any different for a private pension?

    AFAIK there is no mention of a will or executor. In any case from what has been said none of the family have acted wrongly and don't have any liability.

    It makes no difference. If the family had no knowledge of any overpayment and the bank handed the money to the FD then the family have no liability whatever the DWP may say.

    We have so little info to go on that this could go either way, but since the OP has not even logged on since posting this on the 6th May it is unlikely that we will ever be able to say definitively if the family owe anything back or not.

    It's a good job the OP hasn't come back........what, with all the duff advice on here.


    The payment must be paid back.....and the spouse is liable.....end of. Stop with all your 'did she act fraudulently' blah blah blah rubbish. It is a simple overpayment and needs paying back.....whatever the circumstances. Suck it up buttercups!

    The only clearly duff advice is yours since you obviously have no understanding of the law.
