Getting deposit back

We moved out a couple of days ago, honestly we left the place cleaner than when we moved in. My wife is a little OCD and she totally deep cleaned the whole flat.

We never for a moment considered we would not get all the deposit back, however the old agent and the LL have tried to claim it needs painting and they want £400 from my deposit for this.

The issue is not that the flat needs painting because it does, the issue is that it needed painting 4 years ago when we first moved in.

I have emails from back then asking if the LL would have the flat repainted as it really needs it. His answer was a simple "no, he would not be paying for that but if we wanted to paint it ourselves we could."

We did not know how much longer we would be living there, so decided not to paint it ourselves and just lived in it the way it was.

The inventory from back then says clearly the condidtion of the flat, it was a little too optimistic at first so I insisted on some changes before I sigend it.

So where do I stand now please?

The agent has tried to convince me not to go down the DPS case route, I can se they realy dont want that. He wanted to get me to agree to a couple of hundred to repaint it.

I would like to get some advice from here first please, before I reply?

The other thing is, I am overdrawn and desperately need that deposit back ASAP. The greedy LL has no idea what money worries are, his flat has appreciated by more than I paid him in rent over the last few years, and I have paid him over £45K in rent. Now he wont even give me all my deposit back without a fight:mad:

All this after my wife put so much work into deep cleaning the flat, it honestly is nicer and cleaner than the day we moved in.

    Tell the LA to F.O. in the nicest possible way. They probably don't want it to go to arbitration because there's no justification for deducting any money for painting from your deposit.

    Thanks Pixie, I think you are right. They triedto talk me out of it saying it will cost 'you' extra in the long run. I dont think so. I think it will cost the LL extra.

    But what should I do? Shall I go to a dispute right now, or try and negotiate a little longer?

    If they really dont want to go throguh a dispute then just agree to return my deposit now?

    Just log into the DPS website and claim the full amount back. I don't think it will cost you more in the long run at all. I think that if the inventories and emails to your landlord back up what you're saying then it's your landlord who will lose.

    If they don't want to take it to arbitration then they will also agree through DPS to release your full deposit.

    Why should you negotiate at all? there's nothing to be negotiated. The LL needs to give you your deposit back, and they either need to give it willingly or through the DPS. I would ignore any contact from the letting agent as well as they are clearly not acting in your interest.
