Parking Eye POPLA appeal - Using Beavis case as precedent

Hi All

I have received a ticket from Parking Eye for overstaying by 24 minutes at a local car park. I made the standard appeal to them which was obviously rejected but there are a couple of things I wanted to clarify before putting my POPLA Appeal together.

Firstly they included a letter with the rejection entitled - Rejection of Invalid Invoice, the content of which says

"With reference to your correspondence in relation to the Parking Charge incurred on XXXX at YYYY

ParkingEye is a car park management business contracted by the owners of private land to manage its usage in line with the landowner's directions.

All invoices issued to ParkingEye in relation to any alleged loss, cost or expense or payments sought in relation to payment, appeal or any issue by motorists are categorically rejected.

You have not formed a legally binding contract with ParkingEye, under which any right to invoice for payment for good or services may arise; therefore as stated your invalid invoice is rejected"

Is it just me or does this make little to no sense?

I'm not really sure what they are trying to say here - Are they saying that I have not entered into a legally binding contract with them? Surely in that case the whole ticket is invalid?

Or are they saying that because there is no contract they will not consider appeals pertaining to contracts?

The second point I wanted to ask about was this.

Can I call them out on their multiple references to the Beavis case which they are using to illustrate why they (think they) are in the right?

I want to say that despite this case being under appeal they are still using it as evidence which surely is disingenuous and showing of contempt for the process of law.

I'll obviously go for the standard points as well - No GPeOL, poor signage, ANPR, Contract with the landowner. Aldi also seemed open to intervening when I emailed them so I'll get back in touch with them as well.

    I gather you've included a clause in your appeal invoicing them for your time in preparing your appeal. If so, they are stating they reject that invoice. If they haven't addressed your appeal and provided a POPLA code, then you can expect that in a day or two in a separate letter.
