I am not sure this is the right forum nor even the right site to be asking this on but desperately need some advice.
I moved in with my partner a few years ago and then got married but are now in the process of seperating and she keeps threatening me with eviction.
My question is: I am not on the tenancy agreement (but we are married), I pay the rent on the property (council) as she has no income whatsoever so can she just throw me out? as even though I am not on the tenancy I am the one that pays the rent!!!
We live in England as I have heard the law is different in Scotland.
Any advice apreciated. Many Thanks.

The Citizens Advice website seems to have info about this: https://www.citizensadvice.org.uk/relationships/relationship-problems/relationship-breakdown-and-housing/common-issues-relationship-breakdown-and-housing/relationship-breakdown-and-housing-can-you-make-your-partner-leave/
In particular, it says:People who are married or in a civil partnership can't make their spouse or civil partner leave the family home if the relationship breaks down. This is the case regardless of whether both of you, or only one of you, own or rent your home.
...
If the home is owned or rented by only one spouse or civil partner, the other person has 'home rights' which protect their interest in the family home, at least in the short-term.
Spouses and civil partners have a legal right to stay in the family home and neither of you can exclude the other unless a court has ordered it.0 -
Many thanks. Have been completely through all those pages plus found out I do not legally have to pay the reny as I am not a tenant. This will now give me the opportunity to save for a place of my own. She hasn't thought anything through as she has no income to pay the rent herself.0
