making a will

How much can I leave my special needs daughter in my will without affecting her allowances. Thinking of leaving larger amount to her older sister, especially since she will be taking her for holidays when possible. Also would like to make her older sister "in charge" of her. Hoping to live for many years yet and at the moment beginning to look into assisted living so there will not be a rush job, but believe the money side will be effected by any money left to her.

Neglecting for the moment the issue of if you will be depriving yourself of capital for your care.

Many benefits may not be affected by capital - for example - DLA or PIP.

Some will be - housing benefit, income-based ESA, council tax support, ...

It is vital that you setup your will so that she never, ever can legally get her hands on this money, but it is setup in a properly configured trust that may give money for certain expenses.

In this way any amount of capital can be ignored, and it will not rely on the other sister being in a position where she has to be able to have a large amount of capital that may be thought of as hers ignored.

You will need a lawyer to set this up.
