English Smart parking disabled bay with badge

Hi, I took my 80 year old mum to ASDA and parked in a disabled bay. My mum put the 2 disabled badges on the windscreen, when we return there was a ticket on the car for not displaying the badges correctly. At some point one had partially slipped over the other and the expiry date could no longer be seen.

Do I ignore the ticket? I now have an invoice delivered to my home to pay the £70 fine in 28 days.

    No, don't ignore the 'ticket' and you haven't got a fine.

    You need to read the Newbies thread for the exact detail but very roughly you need to :

    1. Appeal to Smart
    2. Once Smart reject your appeal use the POPLA code to get the whole thing cancelled ( once again using the details in the newbies thread ).

    WHile that is going on you need to complain like hell to Asda. Don't let them fob you off with it not being their car park - it will be theirs. Also point out they have broken the Equality Act and that you are considering legal remedy against them if they don't get the ticket cancelled.

    Most of all though, don't worry. You won't be paying a penny and Smart don't do court.

  • I sent off the template letter to smart and have had a response saying I am still liable for the charge and disputing all the points on the template letter I sent in. I have a verification code for the appeal and it says I can appeal to POPLA.

    What do I do now?

    what happened when you went to asda to complain and told asda that unless they canceled the ticket/ charge you would be holding them liable for your costs etc?

    They hate that.

    Get the DM interested, plus the local, write strong letter to disability charities, post on their fora, write to each and every retail outlet served by the car park, in fact raise hell.

    The PPC will in fact have little choice but to cancel the ticket when they are made aware that the EA applies, but in the meantime, make life difficult for them.

    DM normally means Direct Message on public forums and twitter

    whereas PM means Private Message

    the dangers of acronyms ;)

    as for your thread, you have a popla code , what next ? obvious

    you check its validity and expiry date on parking cowboys website

    you then draft a popla appeal and submit it to popla on their website

    all explained in post #3 of the newbies sticky thread, plus in the hotbring reply earlier in this thread too

    If you work with them at their HO, I would have thought you have a better chance than your average Joe Punter to speak to someone who could very quickly knock this on the head.
