    I had a POPLA win against CEL where they alluded a contractual charge to the POPLA assessor. Unfortunately they forgot to send their evidence pack to me.

    I had gone for the usual GPEOL no standing signage etc.

    However, their own witness statement said that they had authority to issue charges for breaching terms and conditions, but showed no evidence that they had land owner permission to grant permission to park and charge for such.

    Hi prj,

    I helped poster Shepps do a challenge against an alleged contractual charge for his POPLA against Athena

    C-M included the appeal as an example in the How to Win at POPLA link and it's since been used by quite a lot of people (or variations of it) both from this forum and Pepipoo.

    Don't know if any of those appeals won on that point alone (Shepps won his POPLA because Athena submitted no evidence) and it will now need some updating but could be a useful start point for your challenge that it is not a contractual charge but a disguised breach of contract.
