Section 106 form holding up exchange

was just about ready to exchange and found out we are waiting for a certificate to do with a section 106, this is to show there is no outstanding monies owed to the council by the developer of the property we are buying (its 8yrs old) seems our sellers solicitor hasnt got it yet despite be asked and chased for it and they only just applied for it from the council and payed the £40 for it a few days ago.
Is this a standard thing or is my soliciter being picky and any idea how long it takes to get the certificate from the council..
We have all agreed a completion date of the 21st May but as yet cant exchange without the certificate and we are a bit suprised that after 3 months its only just come up...
