new house - ground rent arrears & late payment

Hi all recently completed on a house at the back end of February and have been doing various work on it up till now getting it ready for us to move into.

Fast forward to yesterday I received a letter from Robt. Fairhurst and Son asking for this years ground rent plus 2 years arrears and also a late payment fee. - totally £36.

Now it's not the amount I'm peev'd with paying its the fact they are charging me for arrears and late oayments when ive only lived there for two months.

Ive tried phoning on multiple occasions to speak to someone about it but I never get through and upon Googling their name I'm faced with a lot of bad reviews and disgruntled people saying how unprofessional they are and how hard to get hold of they are.

My query is are they allowed to charge me a late payment fee and arrears when ive only lived there for two months and have had no correspondance with them at all about paying ground rent etc?

I phoned CAB and they said I should send them a letter recorded delivery outlining the situation and that I should only be liable for the one years ground rent and that I haven't entered into any agreements with them thus far about paying ground rent so I shouldnt be liable for a late payment charge either.

Is this some snide underhand tactic they use to get more money out of you or is this above board and what goes on in the land of ground rent?!

    Maybe they do not know that you are the new owner, did your Solicitor not check the the ground rent was upto date before you completed?
    "Dream World" by The B Sharps....describes a lot of the posts in the Loans and Mortgage sections !!!

    This is my first house purchase so sorry if I'm a bit clueless with who's responsibility things are etc!

    Take the advice that the CAB have given you and go from there.

    I was just curious to hear if this is a common thing to happen, if it had happened to anyone else and if I was legally entitled to pay a late payment fee!
  • Pass it to your solicitor, sounds like they haven’t done their job fully!
