Ismart

Around 4 years ago I persuaded my wife to to put in a PPI credit card claim with Ismart. We didn't hear anything until December last year when she received a letter from Barclays (credit card company) saying she was due X amount of pounds back, a couple of days latter Ismart rang her and asked her for the £770 she owed them for the claim my wife told them that she hadn't recieved any money only confirmation of what she was due. A few weeks later she did receive the money owed but heard nothing from Ismart. After 3 months had passed we rather stupidly decided Ismart didn't know about or had forgot the money they wanted and spent it. A month later (today) we recieved a threatening letter from a debt collection agency saying they had bought the debt from Ismart and wanted payment. I cannot understand why Ismart would sell a debt they hadn't even attempted to retrieve them selves. Any help would be appreciated. Thanks

    I have very little time for CMCs in general - and even less for ISmart.

    However, you signed up and you knew you owed them the money. It was indeed foolish to then spend it - and somewhat dishonest not to tell them that you now had the money so they were entitled to payment.

    That they decided to sell on the debt is entirely their legitimate commercial right.

    So it looks like the only sensible thing to do is pay what you owe them.

    Any help would be appreciated.

    Pay what you owe or get taken to court. You have no mitigating circumstances here. Best you can hope for is to agree a repayment plan over 6-12 months.
