Hi,

Im looking for a bit of help as im unsure where to go next.

I had 2 loans through a local car sales with Fortis Lease UK Ltd and im pretty sure that i had PPI on these, given that the owner of the car sales didnt mention anything about PPI.

I have one of the agreement numbers so i guess the other wouldnt be hard for them to find.

Trouble is i don't know which department to write to because i have 1 x statement from their office in Glasgow and another one from their office in London.

I don't think writing to both about the same thing would be the answer as this might confuse my claim reply.

The other thing is that ive been told that Fortis Lease no longer exist although i believe that they were part of the BNP PARIBAS Group.

Has any one any advise regarding where i should go from here or has any one else had any contact or dealings already claiming PPI from this company.

Thankyaverymuch.

Your post needs a little clarification - do you have any proof you paid PPI such as the loan agreements?

You state you think you are pretty sure you had it because the owner didn't mention it? Wouldn't it be more logical to state that because he didn't mention PPI you probably didn't have it? When you signed the contract did it mention PPI or did you sign without reading it?

If you have proof of PPI payments then when were the loans taken out - I am assuming you took out the loan from the car company rather than from a bank - is that the case? If so, when was the sale - pre-2005 they were not regulated so do not have to consider your complaint.

  • Hi,

I don't have copies of the agreement so unsure as to whether it mentioned PPI,
as i only have a statement letter with reference numbers on it etc..

The 2nd one was taken out in 2007 and i believe the other was late 2005/2006 ?

PPI was never mentioned, as when it has in the past generally refuse to have it.

I usually secured car loans from my bank but i remember in this particular case the interest rate was less than my bank could offer.

I paid off my loan in 2012

Fortis Lease UK Ltd still exists. Company No. 01881042, registered office at

    NORTHERN CROSS
    BASING VIEW
    BASINGSTOKE
    HAMPSHIRE
    RG21 4HL

which is incidentally also the address of BNP Paribas Leasing Solutions

Fortis was a big Dutch-Belgian financial conglomerate that was one of the first casualties of the banking crisis. BNP Paribas bought a big chunk of it, and closed down some of the bits it didn't want, like Fortis Lease UK. As far as I'm aware, Fortis Lease got their business via brokers and car dealers, so liability for any PPI sale would lie with the broker or car dealer that sold it.

So any complaint would need to be addressed to (presumably) the "owner of the car sales" that "didnt mention anything about PPI".
  • Hi
    Thanks for your response.

Ive checked and the car sales no longer exists.

After looking through some of my paperwork ive noticed that the loan was done through another company then the details were passed to Fortis Lease as the Data Controller & Data Processor.

The statements came from Fortis Lease thats why i presumed that the complaint needed to go to them.

This is my main query as im not sure who i need to complain to given that the car sales no longer exists ?

    Cheers

Try to establish if any PPI existed before you send in a complaint.

As Brock says - the fact that PPI wasn't mentioned (especially with post-2005 sales given they were then regulated) would be more likely to NOT have been on the loan, rather than added without your knowledge - for one when you came to sign up the amount would not match the price agreed for the loan.

Establish you had PPI first before putting in complaints
