Something is not ringing true, somewhere along the line you are lying to someone.
Be it the Spanish government or the UK government about your residential status. Or the amount of hours you work or declaring your assets to spanish authorities. Do you drive? UK car or Spanish?
If you are doing that many hours you will fall fowl of the nmw rules.0 -

The OP hasn't gone quiet. Rules are rules and that is what it states in the EU regulations. I am not going to disclose my salary (will all the others do) and I am not going to state whether my mortgage is a BTL, only that the BS is fully aware the property is rented. That house in the UK (well I should say England as I am not Scottish, Welsh or Irish hence the English subject posted earlier as I was born in England! and proud of it) is our pension when the mortgage has been paid and no worries about care in later years. As I have said previously I pay may taxes and NI in the UK, because I work there and am classed as a CROSS BORDER WORKER! What is it that you people don't understand????? Are you all mega earners that begrudge the lower paid workers some kind of benefit that I would be entitled to if living in England anyway? At least I am working and contributing to the economy, and yes I do spend more than 183 days a year in the UK and I drive a Spanish plated car here fully insured.0

If you really work in the UK, then I don't see the issue with you claiming tax credits wherever you live. I just find it a very sad choice of life. I personally would much prefer to look for work in the country I live in and see my children every day.0
