Ok so we have had quite an entertaining email exchange this week with NPS Appeals team.
Can I just ask how much of this I should discuss in detail on the open forum?
Obviously I haven't and wouldn't mention any company names or other identifying remarks... but I have to assume NPS may be viewing this thread and it would be obvious if I transcript any of our comms.
Would love to share, but wouldn't want to cause any unnecessary dramas for us should this go to court.
Got a great email that the chap in appeals meant to send to their co director but sent to me by mistake... very telling how they view the IAS!

It looks like you're having real fun at NPS's expense - now I'm really envious.
I'm guessing that NPS now realise that they have no hope of holding your company liable and have been trying to "persuade" you to identify the driver. Too bad.

Without seeing your email exchange, I think you should go to the IAS. Apart from the fact that it will cost the PPC some money, you will get a reply from the IAS that would be beneficial in court.
You need to understand that the IPC and IAS are all in one way or another under the umbrella of Gladstone's solicitors who, should it come to court (highly unlikely) would almost certainly be acting for the PPC.
When appealing to the IAS on non-compliance, please be absolutely specific about why the NtK is non-compliant.
Should the IAS then reject this, then in any subsequent court case you could put Gladstone's on the spot by getting them to admit that the NtK was, in fact, non-compliant and, therefore, Keeper liability did not arise. You could also have some fun asking why then, in their other guise as IAS, did they not agree then and save the court time and money.0 -
Hi Parking Prankster,
I will drop you an email off forum now with a transcript of the email exchange between our ops director and their appeals team. As you say no doubt they will know already which PCN this thread refers to, I doubt they have anything similar going on at the moment.
Even so, I haven't given away driver identity and their NtK is addressed to the company which our ops director is representing, so shouldn't be any conflict there. Will happily post what you feel is sensible to.
The general gist in the meantime is the PCC tried to fob off an appeal with the IAS, really poor responses from them on many levels. Still waiting for an appeal to be referred, but an email meant for their co director looks as though they are going to.

In the meantime, it's important that all of your company's contact with the PPC is made through your Company Secretary and / or Operations Director; you will need to stay in the background.0
