PPI - Argos

Options
Hi , I wonder if anyone can help, Argos contacted me to see if they owed me my PPI. I completed the form saying I beleive that the PPI was added automaticlly as I was told that I had to have this to take out the card. Which I did think was discussed at the time of taking the card out.

Apparently when they have investigated they said the PPI was tken out 3 years after sign up and was done when i registered my new card. I know for sure that I would not have agreed to this. But they have rejected my claim.

Is there anything i can do?

If you disagree with their decision and you feel your complaint has merit (and enough evidence and failings to be upheld) then refer it to the FOS as the letter rejecting your complaint tells you.

You said you believed it was added at point of sale and that you were told to have it. However, they have said it wasnt but it was added three years later when registering a new card. So, looking at your complaint, you made an unprovable allegation (which is a very weak complaint) and they are able to show that your complaint is wrong. So, rejection on that point seems fair and reasonable.

So, why do you think they are wrong to reject your complaint?

I agree with dunstonh. However, complaints that people were signed up on calling to confirm receipt of a card have been upheld at FOS.

As it was the Card protection that contacted me with regards to reclaiming PPI - I did think that I had been told that i had to have the protection when i took the card out as this was the case on many of the cards that i took out , however I would have question that at the time.

If it was added when the card renewed I would have definetly not taken this out, i never agreed to anything like that.

I will contact the FOS as i have nothing to lose.

    thanks for the advice

Just be careful, it is probably unlikely, but if they produce a phone recording of you agreeing to it, you will be sunk - state what you believe, do not state opinion as fact

    e.g.

I did not normally take out these plans and I do not believe I would have agreed to it because <xyz e.g. savings, good work benefits or whatever>

    Not

I did not agree to this and it was added without my permission

I believe, prepared to be corrected, the FOS allows firms to submit their phone scripts as evidence of how they behaved (it may not be what a salesman actually said but you won't be able to prove otherwise)

People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.

  • hi all, i know this thread was started a while ago, but i have just today recieved a letter back from argos (home retail group) that my ppi was never mis-sold to me. at the time of taking out the card i do not recall needing ppi as i had never taken it out on any other cards or catalogue, the only time i have taken ppi out was on a loan i had. the letter goes into big detail of how the staff at the time did not provide guidence or advice about this insurance but they did send documents once it had been selected. they have also sent me my orginal credit agreement i signed which states the ppi is 95p per £100, but when i have looked at statements it is showing that it was £1.30 per £100.

i would like some information as to other people who have been refused and what do next, as i do believe i would never of asked for this or needed this placing on my account.

    many thanks in advance

This is not an anomaly you can complain about. When the PPI cost went up you would have been informed.

Since every complaint is judged on it's own merits (or lack of them) there is little point asking for other experiences with this lender. Unfortunately, you have complained that you didn't agree to the insurance and Argos have been able to provide your signed agreement showing you did agree.

If you think you have been unfairly rejected you can refer your case to the Ombudsman together with any evidence you have to support it.

Your rejection letter will have details of how to do this...
