                    Hi Folks,
Righty ho, some of you kindly answered my query a couple of weeks ago about my idiot freeholder who is basically being abusive and a pain in the butt.

Well today, he called in on my partner as he was doing some bits and bobs regarding the sale of the upstairs flat...
The freeholder has decided that he would like to put a gate to replace some our fencing that separates the upstairs and downstairs flats gardens, so the upstairs flat has access to the side of the building so they can clean their windows if they want...
This will mean that upstairs has access to our garden (our property after all) when they fancy... (and yes we will have access to their garden etc...)
Am i wrong in thinking this is a bit much? Have double checked my lease this morning, and there is nothing to say we have to comply with this...
I am more than happy if new upstairs neighbours want to clean their windows and just ask if they can pop over to do it, not a bother.
Freeholder has 'warned' he'll be going to his solicitors to force us to get gate put in!!

            If it isn't in the lease, he can't force you to do anything. Say 'no' and wait for his solicitor's letter (if, indeed, it comes). If someone wanted to establish a right of way over your land, you can charge them for it because it isn't something they already possess. The deeds would need to be altered for both properties and your mortgage company would need to be informed in case it affected their valuation. Expensive stuff really, not that you could be expected to pay for any of it.
 The other flat has an assumed legal right to be able to maintian their property and gain access via your land if it is absolutely necessary, but they certainly don't need a gate to do so. They have to leave things as they found them too.Everything that is supposed to be in heaven is already here on earth.
