DLA to PIP

I'm not too sure if the DWP have got this right.

My DLA (HRM & MRC) ended at the start of the year after I received no points at all for PIP. The mobility car has been taken back unfortunately and the disabled premium and carers allowance premium has been removed meaning a massive loss of money.

I made a right dogs dinner of the PIP claim form so decided to put another one in and not to bother with an appeal (no point in my mind). Have spoken to the DWP and they tell me that I can't make another claim as I am too old!!!! I only turned 65 a few weeks ago.

Can they do that?

    Theres always attendance allowance. which is for 65 and over. Though you dont get mobility with it.

    Yes.
    You need to appeal the original decision not to grant you PIP, explaining why you had issues with the form.
    This can be done up to 13 months after, if you have reasons.

    They told me that, but unfortunately I need the mobility part to get the car back. I'm not so much bothered about the care side as I would expect to get that as Attendance Allowance looks to be the same as DLA was.

    They said no, just 30 days???


    If that was poor advice from them then what do you suggest the reasons for not appealing back in January could be? I just accepted what they said as it seemed the right decision based on the mess of a form that I completed. I didn't really help myself in the first place.

    Firstly that you were misinformed as to the time limit.
    Secondly that the DM could have understood from the form that you were likely to qualify, or that there was sufficient doubt that you should have been contacted.

    I would appeal & get help filling the forms in. I had someone from Dial come to my house to help me. A whole new claim would be assessed taking in the fact that you're now over 65.

    did u get a medical,,got to remember the medical reports go to office ,who then decide ur fate,,
    but as above get elp filling forms in,and dont be shy,,its all about how u fill it in,,the welfare officer will help u

    if you can't get help with the form join 'Benefits and work" its a website that offers independent advice and guides to filling out forms. it's £18 to join but it is so worth it. it shows how the forms are marked and how to word them. it's been invaluable to me for years. it's not run buy the DHSS and the guides are there to help you get the rate that reflects your need..http://www.benefitsandwork.co.uk/
