CP Plus PCN

Hi, Im just looking for some advice.
I work as a HGV driver when I pulled into a MOTO service area(operated by CP Plus) as i was feeling tired and needed to have a break due to EU driver regs bla bla. Upon entering the services i noticed the truck park was full. So out of time and tired i had three options 1) pull up anywhere and block the road, 2) carry on,run over my time and face a possible fine from Vosa, 3) park in the empty coach park to have my 45 min break.
i went for option 3, i Parked in the coach park and decided to go have a shower to wake myself up, which i had to pay for also got some food and a drink.
On returning to my truck i noticed i had a PCN slapped on the windscreen wanting £100 for parking in a coach only bay. as said earlier the coach park was empty, so this is clearly a penalty, rather than a pre estimate off loss ? or not?
I have done some reading but i am still unsure about how to deal with this as most relate to cars and over staying etc.
Any help would be greatly appreciated
Thanks in advance

strange one , I would have asked MOTO where to park , the law is the law and you are entitled by UK law to park for a max of two hours as a car driver , might be more for a waggon , dunno ,
by denying you parking they are aiding you to break the law.
phone call or visit to MOTO , and get them to accept you were OK in those circumstances , then tell CP plus to "do one"0 -
and in the mean time why mot let the Government know how CPP's are forcing you into impossible choices .....

thanks for the input this may sound daft but, I am going to write to Moto but do i write it in 3rd person as the RK? or as the driver? and not say who the driver is to moto ? or does that just apply to CP plus?0

In this case you reply as the driver and you stopped for safety reasons as prescribed by the Road Traffic Act.REVENGE IS A DISH BETTER SERVED COLD0

CP Plus NTKs are only possibly able to hold a driver liable as they don't use a POFA version. So the last thing to do is to say you were driving!
But it may be difficult for the OP as the lorry is probably not his.
I would write as keeper - not registered keeper, not driver (use the NEWBIES template).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:
Home»Motoring»Parking Tickets Fines & Parking - read the NEWBIES THREAD0 -
Also, a note to the OP.
You mention "A possible fine from VOSA", they are now the DVSA and under Tachograph Regulations, you are able to depart from the regulations provided that safety to others is not compromised until you can reach a "Safe place to stop".
You could have easily done a print out and put a note on the back like "Unable to stop at xxxxxx services, truck park full" and carry on to the next one.
If you felt you would have been a danger to others by carrying on, then you were certainly right to stop.
Not that it can really change anything now, but I know what you mean, it's a nightmare getting parked when all the trampers are sleeping, maybe park across the front of a few lorries with curtains shut.
I certainly would take to Facebook and Twitter, let them have it. Social media does work sometimes.
These places make a fortune from trucks (Charging up to £26 per night for parking) and they would soon miss it if the 50 or so lorries decided to park elsewhere and leave the European trucks to park for free, they bring no money to the services as they mostly self-cater, and obviously CP Plus can't scam non UK vehicles, so they don't pay the parking charges.
Before you do anything, you need to wait for the NTK, if the company will pass it to you without paying automatically. We’ve had to remove your signature because your opinion differs from ours.
