Laymans english please to sensible questions

I am anticipating an invoice from everyone's favourite company in relation to a short overstay at Aldi.
Now i am quite happy having previously gone through the process a couple of times with other PPC's, however in preperation for the invoice wondered if straight foward answers without legal jargon could be provided to the following questions

1) Which individual legislation are PE pursuing with their invoices,ie Trespass,Contract law, etc,etc and what section so i can research in my own time and speed

2) Whilst the Beavis matter is heading to the Supreme Courts, will the ruling by CoA have any legal standing, which no doubt will feature in subsequent PE letters.

3) Will PE have any rights to pursue court action on behalf of the landowners with the usual license/agreement they hold for such car parks, or is it still the case only the landowner can take legal/court action

4) Is GPEOL still in play as far as appeals

5) Do ANPR cameras require planning permission (the ones in question are on entry/exit to a multi strorey, so not on large poles. I have asked the question of my local council planning dept and i am awaiting a response and on research can not find any any such planning applications for such on the website.

    There is no evidence of any Aldi customer being pursued to court by PE. There's a strong possibility that Aldi has not agreed to that step in their contract with PE. So, in some regards, you're 'safer' at Aldi.

    The easy way to get this overturned is to send with your initial appeal to PE copies of Aldi receipts/redacted copies of cc or bank statements for purchases on the day, especially if >£30 (which seems to be the secret threshold).

    So no need for elongated questions or legal jargon, just take the easy route and kill this off.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    It would be a nail in ALDI's coffin if PE did come out and say "We pay for a fishing licence in ALDI Carparks"

  • Thanks, i am aware of the normal way to appeal such matters, and in this case i do not have any receipts etc.

    I was raising the points not only out curiosity but due to my utter dislike of the PPC world, and having access to a national legal database which throws up all manner of weird and wonderful pieces of legislation if i can cause any sort of pain to which ever PPC i am not the sort to sit back.I have already submitted a FOI with regards to the orginal and subsequent planning applications.

    I don't think even PE know what legal basis they are using to justify the money. Certainly none of them make sense.

    Ive helped a few people with Aldi overstay/double dip issues, and the easiest method is to go to the Aldi store directly with a copy of the letter from parking eye and ask them to cancel in store.
    This approach will have the benefit of not having to worry about popla, so called appeals to parking eye and so on, plus it will also give the manager a ( minor) bit of greif
    From the Plain Language Commission:

  • With the lack of responses to point 1 i was considering entering the hornets nest and e-mailing PE and copying in BPA, however surprise surprise PE have no serviciable e-mail address for genuine enquiries.

    With such an open, transparent and upstanding nothing to hide company i found this unsual!!! Does anyone have a e-mail address for them to make such an enquiry

    I find it reprensible that in the NtK they are quite prepared to quote chapter and verse re PoFA but no details on the legislation they are persuing their invoices on.

    Surely this would be akin to receiving a Summons from the cops saying you are being prosecuted under the Road Traffic Act but no further details, then finding out on the day what the actual offence is and would raise issues how are you meant to prepare a legal defence if you do not what you are defending.
