can i get refund on cc

hi there, i had a friend over who made a call and ordered a holiday on my credit card without me knowing. once the paperwork came through i immediately contacted the company and my credit card company to explain what had happened. the holiday company said that as the holiday was booked only 4 days before departure there was nothing they could do and the credit card company reckoned there was nothing they could do either. i wrote to the card company stating that as the holiday was booked firstly without my authorisation and secondly as it was done over the phone, surely i had a chance for a refund - phone selling and all that?! - what should i do? is there any recourses? i hope someone can help.

    Your friend has committed a fraud and should be reported to the police.

    I think your card company should refund you as a fraud has been committed and the card was effectively stolen from you (and then returned) without your knowledge.

    You would have thought with the amout of fraud that a travel company wouldn't take the booking if the name on the card doesn't match the name of the traveller!

    Unfortunately, holidays are exempt from the distance selling regulations so you will not be able to go down that route.

    Did your friend expect to be able to take the holiday?

    The first port of call is to ask your 'friend' to reemburse you.

    If not then I would only think the CC company would refund the amount after you reported the matter to the police and fraud was established.

    You have no cooling off period with holidays.
    However this sounds like fraud.

    How did your friend get hold of your card?
    You should report it as fraud and not just a mistake. Using the correct words e.g. "fraud" and "stolen card" means you'll get different treatment.
    So far it sounds like they've just interpreted it as a change of mind and in that case it's just "tough".
  • you won't get your money back unless you are willing to report your friend for fraud. i work for a high st bank and this is what they say.

    Spot on 3LittlePigs. If you claim to the credit card company that it is fraud, you need to back this up by reporting the offence to the Police. The card company would be absolutely justified in rejecting the fraud claim if you are not prepared to do this, as it could appear to be collusion to scam a free holiday.

    thank you so much to everyone for replying. i don't really want to report "the friend" and they have promised to pay me back. if it transpires that they don't pay back the monies - £700 (eeks!) - do i have a set amount of time that i must report this?

    Why can't they pay you immediately.
    They should get a loan.

    Be firm with them.
    It should be their problem not yours.
