That never caused a problem I still got my NCD with my new insurer.
I told them, that's why they wanted their cashback back and cancellation fee,
This was all explained to my new insurer.
The car was traded in as scrap.
Is it not the person who drives the car that is insured to drive the car not the car?
If they had done their checks they would have taken it away as you cannot use NCD on 2 policies at the same time.
Just because you trade it for scrap doesnt automatically mean it gets scrapped. There are several threads on here and the Motoring thread of people saying their car went to a scrappy with accident damage and they see it driving around repaired a few months later.
Its more complex than a person -v- car. The RTA makes the insurer liable for a vehicle it insures if no other insurance exists for the driver and the driver is identified. The RTA, and your contract of insurance, also gives the insurer the right of recovery if they are made to cover such a claim. When the policyholder is complicit in the breach of terms (eg allowing an uninsured friend to drive it or selling it but not cancelling the insurance) the rights of recovery are against either the driver or the policyholder0
