PPI claim on behalf of a relative

A close relative of mine was planning on signing up with a PPI claim service but I'd read that it is easy to do it yourself so I begged them to let me do it for them instead.

A few weeks later all I've managed to do is a bit of research here and there and get a bit confused.

They don't know whether they have definately had PPI but have had various loans etc over the years and there is a good chance that they have without even being aware of it.

They have given me details of mortgages with Leeds and Holbeck (do you get PPI on mortgages?) and their current account with overdraft with the bank with whom various loans will have been.

Is it possible to just send the step 1 template letter to each lender with a cheque, or would I need to send a letter for each separate loan? Do I need to find out account details for each loan first? Some of the accounts will have closed more than 6 years ago.

It is likely that they still have all relevant paperwork but unlikely that they will find it anytime soon.

Thanks for any help - I'm not really sure where to start!

    Oh, and when I say 'on behalf of' I just mean helping them with it, I appreciate that they will need to sign the letters etc.

    First thing to do is ask them then.
    They have given me details of mortgages with Leeds and Holbeck (do you get PPI on mortgages?)

    MPPI is typically a standalone product. So, you dont get it on a mortgage like you do with a loan or credit card but have it like you would life assurance. Its one of the reasons most MPPI complaints fail. The others being that it is considered a more valuable thing to have on such an important debt and that employer benefits dont usually prevent it from paying out.

    You can do it per bank. Or you can just ask the bank outright (*in your relatives name)

    In that case I think I just need to start with one letter and a £10 cheque to their main bank.

    Sorry, another question, should I send Martin's step 1 letter to the branch address or to a head office address? (For Lloyds Bank)?

    The DSAR (£10 for paperwork) goes to the data controller of each department.

    Do note you will need stronger complaint reasons than "didn't know I had it" as that just implies they signed things without reading them which isn't a miss-sale reason

  • Hi - first posting here, so apologies if I have piggy-backed onto the wrong thread. In having a clear-out, I found all the paperwork relating to an old mortgage with the Leeds and Holbeck, going back to 1991 and which includes the ppi. Obviously, this is quite a few years ago now - would anyone be able to advise whether it's worth persuing a claim? I transferred this mortgage to Northern Rock, in 2000.

    Many thanks in advance for any advice.

    You havent given any reasons for complaint. So, we can't tell if you have a complaint worth pursuing. Mortgage PPI has a far lower success rates on complaints as it generally a more important product (covering a debt with lifestyle changing consequences if it goes unpaid). It is still possible to succeed on a complaint with MPPI but without knowing your reasons, no-one can say.

    As I recall, Leeds & Holbeck had a number of products where PPI (or rather ASU) was compulsory in the early 1990s. If it was such a product, you have no grounds for complaint.

    Leeds & Holbeck was also reliant to a large extent on independent brokers to sell its products. Your complaint would then be against the broker, not the lender.

    Since the broker would not have been subject to any ombudsman scheme at the time, and may well no longer exist, your complaint would fail at that point.

    Get past those hurdles and you still have the problem that the product is generally suitable.
