How to get back deposit?

Hello,

I'd like to ask for an advice how to deal with the following:

I was looking for a new place to rent and a girl from work said, that she is in the same situation and suggested to group up, also with a couple she lived in their shared house at that time, and rent a whole property together instead of separate rooms.

So we did, however it was done all in her name only. I didn't have many experience then and trusted the girl and basically did what she suggested - me and the couple sent her money for deposit and first rent, which she sent to the landlord and then we were always sending the rent to this girl's account and she was resending the whole month rent to the landlord.

All went well for over 1,5 years until the tenancy ended and we moved out.

Yes, it's going to be about the deposit now.

She claims she sent it to at the beginning to the landlord who put it into the TDS. Now it is over a month the tenancy ended and we still don't have the deposit back - according to her.

I asked her to show me the reference number from the TDS or any proof the money was put in there, but she wouldn't give it to me. Also under various excuses is unable to pass me the landlord's contacts.

Now she is saying that the landlord did some deductions from the deposit and that she raised a dispute at TDS, which she did a month after the tenancy ended, and TDS has another 21 days to 'look into it'.

As you'd expect, the question is, what I can do to get my money back?

    It's quite common for the deposit to be registered under the lead tenant's name with a joint tenancy which is what sounds like has happened here.

    When there are disputes between the landlord and tenant about deductions it can take some time to either come to an agreement or let the deposit scheme arbitrators come to a decision.

    Until the deposit is returned to the lead tenant there isn't a way for you to get your money back any quicker.

    I'm happy to wait for the dispute to be sorted out, but the thing is, I don't know if what she says is true, if the deposit was put into the TDS at all or if there are any deductions or disputes.

    I asked many times directly for phone number or other contact of the landlord and any letter saying the deposit was, well, deposited.

    Any idea how long can it take for the deposit to be returned? When I can safely assume that she has it back?

  • You could search here: https://www.tds.gb.com/is-my-deposit-registered.html to see if there is any information on the deposit. That would tell you if it was ever regisitered
