Sygma / Creation refuse to update credit file

Hi
I went BR on 25th Jan 2013 and was discharged on 25th Jan 2014.
I have been trying to get Sygma / Creation to update my credit file ever since discharge. Having been told several times that they will deal with it. I checked Experian and Equifax the other day they have still not reported the correct dates.


I had a credit card with Sygma and car finance with creation.


So Equifax, show Sygma default as 14th Aug 13 and satisfied as 3rd March 14
Yet creation have the correct details for the car finance. (25-1-13 & 25-1-14)


On Experian they report the credit card with Sygma as defaulted 25-1-13, which is correct, but no satisfaction date.
Creation show on Experian the correct default date but no satisfied date.


Now I have spoken to them again today and they refuse to update the info, saying that they have done everything possible to try to update it, but their system will not allow them to do it. They also said that as the debt was not paid, they will not mark it as satisfied / Setttled as it is not a true reflection of the account!


I even did a quick search of MSE and found the info on getting this problem sorted and directly quoted what it said about ICO etc, to which she replied with, If you would like to make a formal complaint, I can put that through for you, but can't guarantee it will do any good.


I guess I will have to wait for a response to the complaint, but should they still refuse, what else can I do?


So frustrating, especially when they have conflicting information on Equifax and Experian, which proves they can correct the information. Just to add I have spoken to Creation re the car finance and not having a satisfaction date on Experian, to which they were quite helpful and asked me to email the info again to a specific department and said they would update it. So why Sygma are being so stubborn, I do not know.


Any advice would be appreciated.

    If they refuse you take the complaint to both the ICO and FOS.

    I just don't understand how they can report half of the correct info to one CRA and then say they cannot possibly do anymore to try and update their system. They reckon it won't physically let them, so if they stick to that, and I complain to the powers that be, what could they do?
    As in, if they stick to their guns and say they have tried to update it but their system just will not allow them to change the date etc, how can it be done?


    Can the ICO give permission to the CRA's to change it?

    They can change it, as if not no-one would ever be able to get their accounts marked as satisfied etc.

    In the end if ICO and FOS find against them, ultimately you can use the courts to force them to change it.

    Start getting the ICO and FOS involved NOW. It's clear these creditors will just continue to feed you lies until you do.

    Ask them to write to Sygma / Creation. They may take more notice of that, as the FOS can order them to pay compensation and correct things.

    If you feel the information has been recorded incorrectly on your credit report by your lenders please let know us, I understand that you feel your credit report for you account with Sygma is missing the satisfaction date.

  • Exactly the same situation, I went bankrupt on 09/05/2011 and had 5 cards with them however on the credit file they have recorded late payments from May and then default me in November 20011, which isn’t on. I did make an official complaint however I keep getting letters saying they need more time, more time, then at 8 weeks, apologising it’s been 8 weeks and I can complain to the Ombudsman if I want but they hope I would wait as the investigation would be complete shortly. Well I didn’t wait, I put a complaint into the Ombudsman 8 weeks to look at just changing a date is beyond a joke, it’s clear just by looking at the dates on my bankruptcy order and discharge order that the dates they have are wrong, Barclays did it way quicker and even apologised and gave me compensation for the incorrect dates.

    Hopefully they will now take a proper look at the complaint now it’s with the Ombudsman

    It's ridiculous! After posting this I found out yesterday that Sygma after my phone call changed the default date to the correct date and then changed it back to Aug 13!! So much for not being able to change it!
    Needless to say its had a massive impact on my experian report who tell me that by doing what they have they have it now looks like I have a new default!

    Experian have sent them an email asking why they have done it.
    I rang Sygma again and told them I was not impressed and that they obviously lied, saying they couldn't change the date, told them again that they are not complying with Data protection act and quoted from ICO information.
    The guy I spoke to said he couldn't understand why they weren't updating it to the correct date.
    Waiting for their complaints team to investigate and get back to me.

    Sygma are a shambles I had exactly the same run around with them eventually they agreed the data was wrong, they werent able to correct it and so they removed the entry from my credit files.
