Odd that a thread about Tesco got parked in the wrong forum, a bit like how they parked those figures in the wrong year.0

Except that the money does not go to Tesco, but to the parking company.anotheruser wrote: »But this is where I have questioned many times.
The ruling surely is that it IS enforceable, but only up to the amount of money they have lost by you overstaying.
Potentially someone could have used that space and spent £80 in store, thus £80 is a fair price to pay?
If it's clearly not ever enforcible then why do supermarkets/train stations/councils even bother, as they just look silly surely?I can afford anything that I want.
Just so long as I don't want much.0 -
A recent Court of Appeal judgement has ruled that these charges ARE enforceable

To be fair, that judgment is a bit of a fudge.
No one wants the situation where consumers can be held to ransom by companies on the basis of trivial or manufactured contractual breaches. Hopefully the wisdom of the Supreme Court will endure.
Ultimately, though, this is a mess of the Government's creation, and they really need to sort it out by making the legislation more definitive.0
