I didn't receive letters from DWP - anyone else have this problem

My application has been turned down as I failed to attend an assessment that I knew nothing about.

They allegedly wrote to me twice giving me and then reminding me about an appointment.

I have to prove that I did not receive letters... tribunal is tomorrow.

Any help would be great, especially if I can find out if this is a common problem.

They have told me I can send in a new PIP application but that would not be backdated to the date of the initial application.

    Ask them to provide copies of the "2 letters" and their proof of posting.
    Contact your MP and put in a complaint about this.
    If you send them a new PIP application make sure you send it by special delivery and tracked.

    It's just simple bullying from them, their idea is that if something is sent by them it will never get lost.

    Its a little late now but welfare rights may of been able to send someone to help you and make sure you are not bullied.

    Speaking to a MP is the best thing to do as above says but sometimes you have to push the staff to do something.

    Strictly speaking you don't have an MP at the moment, and your previous one isn't going to be one bit of help the week before an election.

    All you can do re the tribunal is explain what happened. Unfortunately I do think you'll struggle, the DWP are not required to provide proof of posting (it would be unrealistic for them to do this for every letter sent), and whilst one letter going astray will generally be accepted, two is less likely to be believed.

    Too late now but I would have resubmitted the claim as soon as the first was declined - this would have minimised the time you were without payment.
  • I did have help from a local organisation in putting my application together and they were told by DWP that I would be sent another appointment. They have also given me a letter confirming that other claimants they are dealing with have failed to receive letters too. I was hoping that I could find out if this was a common problem.
