Default On Credit Report - COmpany Held Completely Incorrect Address For Me

Options
Hi All,

Thanks in advance for those that can assist.

Late last year I received a letter from Robinson Way regarding a Hoist Portfolio debt they had bought from Santander. I rang them and queried this with them as I didn't recollect the debt (bank overdraft apparently).

I have been chasing them for statements but nothing yet.

My main question relates to a call I had with them this morning where they stated an address on file that was not one of my previous addresses. Previously I lived at a number 6 but they said number 60 was on file.

That means they would have sent the default notice to number 60 and not 6, therefore I would have had no chance of receiving it.

Do I therefore have the right to request that they remove they default from my credit file as I had no chance to prevent it?

I will obviously contest the debt on other grounds but my main aim now is to have the default removed as I need to get a mortgage and struggling!

Thanks for your help!

The credit-file entry will have been instigated by Santander after they had tried to contact you without success. Your first port of call should, therefore, be Santander to establish the circumstances. Register a dispute with them if you they are unable, or unwilling, to justify the alleged debt.

Advise the debt collectors in writing if you do dispute the debt. They should then give you time to resolve the problem.
