Hi all,
I am writing to the forum on behalf of my brother who has received a LBC from Gladstones Solicitors on behalf of DE Ltd due to parking on Staffs Uni without a permit on 4 occaisions.
We are in the process of writing a defence and wondered if anyone on here could help as the outcome of your case seems promising.
Basically the facts of the case are that my brother has parked without a permit on 4 occaisions; however on each of these times he has had a disabled badge displayed in his car. Furthermore, on one occaision one of the parking attendants actually cancelled a ticket after checking his disabled badge to make sure it was him! Also, my brother has applied for a permit but not been issued with one so there was no way for him to get around this problem.
Any help would be great thank you! We have until 22nd April to reply to this email so any thoughts would be much appreciated!

Just search this forum for Staffordshire - I'm sure there have been quite a few threads you can look at for inspiration.

They are in the IPC and operate a contractual charge. This attracts v.a.t.

By not charging vat the judge may be persuaded that this is not a contractual charge, but liquidated damages for a breach of contract, which of course means that the amount must be a GPEOL.You never know how far you can go until you go too far.0 -
No they havent accounted for vat, they are saying it's a debt. I've asked them to explain how they have calculated the loss but they didn't explain it, they said it's the charge you agree to pay for parking there plus appointing them to chase the debt. Thanks for your help.0

In which case it is a contractual charge, which attracts v.a.t. Ask them for a vat compliant invoice. If they refuse shop ' em.
