Rental - Notice obligations when lease expiring

Just wanted to ask a quick question regarding a notice period longer than the remaining time on the lease.

As a tenant with an obligatory 2 months notice period, is the full 2 months required if the AST expires in just one month?

Ultimately, if not, then it would be necessary to signed a new or extended AST in order to comply with a previous AST?

Additionally, when the notice period is defined as 2 months and nothing further is specified, is that normally taken as 60 (ish) days or 2 calendar months. I.e would I need to stay/pay until the end of October if I handed in notice now?

    You can leave on the last day of your tenancy without giving notice.

    If you stay one day past that, you have to give two months notice - that two months needs to end on a rent day.

    I agree with Doozergirl.

    Also, am surprised you have 'obligatory 2 month notice period' as for the tenant, 1 month is usually all that's required...?

    In my experince within most ASTs it's 2 months, for periodic it's 1 month.

    Opinion is generally that at the end of an AST fixed period you can just walk away, but it's courteous to give some indication to the LL, given that lots try to retain deposits etc, you're better giving notice. Some may even dispute the "walk away" and charge for no-notice, which you would probably win on dispute, but do you want the hassle?

    I tend to ask tenants just before the final month, whether they want a new 6 month, 12 month at the same rent or convert to periodic. If they do nothing I tell them it's gone to periodic, and requires 1 month's notice.
