Excel members of IAS, but using PoPLA PCN?

I have a question?
Is it legal to issue PCN's with Popla info printed on them, when the issuing Highwaymen, Sorry I mean PPC are members of IAS?
Your thoughts and advice please.

Surely this would be a good line of defence if the parasites ever grew large b***s and took you court.
Even the police and the CPs lose court cases because of incorrect paperwork?
I have asked this question because I'm helping a neighbour fight a PCN she/he received while parking in a disabled bay without a blue badge. There is mitigating circumstances as to why the vehicle was parked there (and a winning reason in any normal company's/persons eyes) but we all know what that means in a Kangaroo court
.
The advice I have given so far is:-
1, Do not disclose who the driver is.
2, Await NTK
3, Request the ticket is cancelled by the landowner.
3, If no joy with step 3 appeal to PPC but expect to lose
Now this is where the knowledge I gained from your good-selves ends, as my fight was with Parking Lie and POPLA (Modern day Highwaymen) where I had 4 PCN's cancelled. I have read the stickys and this is where I may need correcting but my understanding is, ignore the threatening letters from bogus debt collectors an the like and only reply to court papers which I believe is highly unlikely as the PPC's wont win there????0 -
Received more info this morning,
So were off today to the location in question to try to have the PCN cancelled and to complain very strongly about the actions of Excel.
At our morning coffee discussion this morning the father of the RK informed me that the car park was empty apart from the single drop off bay which had a gentleman sitting in his vehicle. Apparently his behaviour drew the drivers attention to him. Basically he was looking very shiffty. I suspect this was the employee of Excel who placed the PCN on the vehicle.
Now I know it doesn't matter whether the car park is full or empty but I do know the hospital quite well, and if the events described by the driver are true (I have no reason to doubt him/her) then it looks like underhanded tactics by the PPC. The car was moved within 5 mins (patient helped into hospital) and the parked drop off car had gone and the ticket issued. As far as I'm aware there are no PPC cameras installed at the hospital (will check today) and its highly unlikely that the Excel employee could of walked from any other of the car parks, issue the PCN and then disappear from sight, well unless Usain Bolt has got himself a new job :rotfl:
Will update once I have tried to have it cancelled by the Landowner/Hospital
I wont rest until these company's go Bankrupt or at the very least operate in a fair an lawful manner. Damn you PPC's, may you all hang your heads in shame :mad:0 -
what was the date of the offence , and what was the date of the first letter you received from them0

Claiming to be a member of a trade body, when you're not, is an offence.
If they are simply using up old paper, then they need to be very careful. If the letter implies, by stating that POPLA is available that they are members of the BPA, and they aren't, then they could be in trouble. Trading Standards ought to be notified.Je Suis Cecil.0 -

EF all I will say for now is its all above board with dates/time and deadlines so far. Sorry but would like to get it cancelled 1st before giving dates out. You never know who's watching heehee
Well as posted earlier, We have now visited the hospital to gain more evidence of the shambolic way that this PPC is operating.
Not only are their PCN's printed wrong, I now know that their signs are too?
They have the BPA logo on them. I'll need a bit of help here. Does the sign having BPA on it, mean that it is a POPLA appeal system or is it for both POPLA and IAS??? I've had a look on the BPA website and Excel are not there and its stated the list is as of April 2015 so think we've got them there :rotfl:
Needless to say off we went into the Hospital with the piece of scrap paper, sorry I meant PCN
. To challenge the entire grounds on which this toilet roll had been issued (sorry can't help myself:rotfl:).
Myself and the RK proceeded to take pictures of the signs in case of future battles and made our way to speak to anyone prepared to listen.
I wont bore you all with the details but I finally got an e-mail address of the man with the power to remove/cancel this PCN. Can I also say thank you to the staff at the hospital who were all more than happy to help, and that you all do a great job looking after miserable old sods like me :T I suspect that some may have perused this and other sites concerning these PPC's after the knowledge was passed on and the fact that they get tickets issued on a daily basis and PPC, IAS dont care, no badge displayed, pay up :mad:
I have now with the RK written a nice long draft e-mail to the man with the power highlighting the wrongs of Excel and hopefully he will use his undoubted abundance of common sense and cancel without delay. I will carry on researching and send it when I'm confident its ok.
I understand that the NHS needs to generate funds to carry on the good work that they do because the country is skint, but surely they must research these companys and should think twice about who they jump into bed with. After all they will be the ones footing the bill if/when it all goes T**S UP0 -
Excel are BPA members, but only corporate members. They are no longer BPA AOS members ... they are IPC AOS members.

Just double checked the signs from the photo's we took today, and the one you have shown is present on all the sites signs. So looks like should be OK there. There is also a logo/badge to the left of BPA with CCAS onit?
Is there anymore advice on how to take this forward or am I/we going in the right direction?

After getting passed from pillar to post we finally got an address of the relevant people who could make this unjust PCN go away.
A polite letter was sent explaining the mitigating circumstances(I know these mean nothing to PPC's) and some of the possible legal implications of Excel issuing misprinted/old PCN's and displaying misrepresenting sign-age. Hoping this would be enough for good honest people to see sense and cancel this PCN
Unfortunately the NHS trust in question has decided to uphold the actions of Excel and we have now sent another shall we say strongly worded letter informing the trust that the RK will not at any cost be paying this ticket unless ordered to by a real court and not the kangaroo court that Excel likes to hide behind.
They have also been informed that the local press may want to hear about how the trust can treat their patients/pregnant women.
We would really appreciate any advice on how to proceed?
I feel I have gone as far as I can with my limited know how obtained from the regulars here. Should the RK go to court or pay up. I feel sick just typing that
I'm disgusted that the trust could even dismiss this PCN in no more than 10 words.0
