CCJ whilst out the country - how to deal with it?

Hi everyone,


I've been out of the country for the last 6 months and have learnt that I've had a judgement made against me for an old loan. I've missed all the dates and therefor have now received a demand to pay up. What steps can one take to go back and object to this - if I even can!?


I'm trying to rebuild my credit and this has really messed it up.

    You must have had communication from the debt collectors before you left the country? It is very rare for a debt to escalate to the CCJ stage in such a short timespan, the collectors will try and collect for up to two years before that point, especially in respect to a loan.

    You can apply to have it set aside. You might see about using the fact that the action was taken while you were out of the country but take advice on the matter from CAB.

    If you want to defend the claim then you can ask for the judgment to be set aside on the basis that you received none of the paperwork. You may need to show you were overseas as the application for set aside can be contested. If however you accept you owe the money it might be tricky..

    If you intend to defend the claim, if you have a reasonable expectation of being able to make a valid defence and if you can show good cause as to why you didn't respond to the claim within time limts then you may be able to get it set aside.

    If you have no defence and you owe the money then pay it or make an n245 application to pay by installments but as far as the judgement is concerned you'll have to suck it up.
