Discriminated against as pregnant by HSBC - is this allowed?

I have an existing loan with HSBC. I called them this evening to refinance it to lower my monthly payments and take out an additional £2000 on top of the £6333 outstanding.

The person I spoke to refused to take my application as I told him I am pregnant (not due to be on maternity leave till October!)

Is this allowed? I feel very discriminated against. He told me to get my husband to call back and do the loan in his name only but I am the main breadwinner and earn £10,000 a year more than him. Also the existing loan is in joint names and I wanted to keep it that way.

Has anyone come across this before?

    Yes it is allowed, they can refuse a line of credit for whatever reason. In this case they see you lowering your monthly repayments *and* taking out more credit (which would probably be enough for a no anyway). They then have the uncertainty of your future (unless you're repaying 1,000 a month from now until October).

    So they are refusing your request on affordability grounds.

    Although if you are pregnant by HSBC they should pay some child support ;)

    Borrowing prior to reducing your income isn't usually a good idea.
  • It is the same if you wanted to remortgage, as they look at your afordability and being pregnant or having kids means your expenses will increase for childcare etc, meaning your disposible income is less.

    as i haven't applied for a loan for years i wasn't aware that asked if you were pregnant or even if you had children.

    Is this the case now that they go that in depth?

    I suspect that the OP was either asked, or told them, that her income would be falling in the near future.

  • We didn't even get to the application to look at affordability - it was just a flat no because I'm pregnant which I thought seemed a bit close the edge discrimination-wise.

    Did he / she actually say the reason for refusal was down to the pregnancy?

    On the basis that they didn't properly assess an application, effectively refusing to let you apply, you might be able to kick up a fuss and bag some compensation to go away.

    It wasn't because you were pregnant though was it? As above you wanted to reduce your monthly payments and you want to increase the loan.

    A sign that you maybe struggling financially.

    That may be the case but that isn't what she said happened. Pretty rough if thats the case, id complain.
