Sorry if this is in the wrong place, but thought i'd ask for your advice if any one can help
My sister bought a well known brand of pushchair from a large retailer, the pushchair was advertised as having a five point harness (which in my opinion means that it is attached to the pushchair at 5 points, ususally the main fastner, the two at the side and two at the top near the shoulders) this model however only fastens to the pushchair at the two sides and at the buckle meaning the shoulders are free.
We both feel that this isn't safe as if a child was to throw themselves forwards, or you were to bump into something the child wouldnt be restrained properly. she has been back to the store where she purchased the pushchair and as yet they will not agree to her returning it and exchanging for another item (it has literally been lifted out of the box and put back in), the manufacturers claim that if the harness is tightened enough then the child will not fall forward
sorry for the long post and hope it makes sense, what i need to know for her is wether she is entitled to an exchange as she doesnt feel that it is safe.

has she got any documentation to show the 5 point harness description?
It will make life easier if she has. She hasn't used the item therefore has not accepted the goods I think she has a very good case for rejecting the goods and getting a refund.
A call to consumer phone line / trading standards may be helpful too.

I am going to guess that your sister has bought a Mamas and Papas which does have a 5 point harness and the top bit is attached via a loop in the back of the seat . I have a Peg Perego (M&P European brand name) Pliko P3 and as they have rightly said , if the baby is strapped in tight enough the baby WON'T fall out . I can also assure you of this , me being the mother of a head banging 2 yr old lunatic who takes great delight in throwing her self back and forth as hard as she can in her buggy :mad: and she is a big girl too and never once has she fallen out of her buggy , many a time the force from her throwing herself about has up-ended the buggy but never once has she come out of the buggy . This type of harness is actually considered safer than the "normal" harness as baby can't strangle themselves with the harness as when they move the harness comes out of the loop in the back of the seat .

Natalie you guessed right, but the model that she has got does not have the loop attached to the back, my concern is not so much that the baby will fall out but more of it banging its head on the bar across the front.
I will pass your thoughts on to her, as apart from this she really likes the pushchair
Sarah - the reason that she is struggling with a refund is apparently because she paid for it a few months ago but kept it at the store until nearer the birth date, which they say takes her out of her 28 days£2008 for 2008 member No.4140 -
Don't worry about it being over 28 days, this usual returns period does not apply when you are applying a statutory right (If you look at their policy, it will usually state something like 'Your statutory rights are not affected').
