Hi guys, looking for a bit of help. Basically I work as a football coach and I am on a 0 hours contract. I have worked for my employer for well over 4 years now and I was recently informed by my manager that he was told by HR to remove me from the staffing for last week as I was under investigation. I called HR and was told they couldn't tell me anything and I would be contacted I'm due course, my manager also doesn't know why I have been suspended.
I'm now left with no income and starting to get really stressed out by all of this. Can anyone help me out with some advice please. Thanks

OK, now this has a thread to itself......
The first major problem here is the zero hour contract. It makes pretty much everything else regarding employment rights meaningless as they could simply give you zero hours from now on if they so choose.
Assuming they don't use this dodge and do things properly then yes, they will need to conduct an investigation and then, if they feel there are grounds, invite you to a disciplinary hearing. For such a hearing (although technically not for any prior investigation) you are entitled to be accompanied by a work colleague of your choice or a trades union rep. You would also be entitled to have details of any allegations and evidence so you can offer a defence.
Normally such a suspension would be on full pay but, again on zero hour contract, that too is meaningless.0 -
Do you know if I have the rite to know what I am being accused of?. I tried to contact HR with no luck and was told I would be contacted in either a telephone call or written letter in due course0

I have been doing some reading on this and certainly in the case of unfair dismissal (at an Employment tribunal) when someone was on a zero hrs contract the claimant was awarded money in lieu of salary which was based on a 12 week period previously worked.
However, I do not know whether this would apply for someone being suspended under a zero hours contract.
Other reading suggests that if your contract contains clauses relating to sick pay/holiday pay this makes it more than the usual zero hours contract and gives you greater sway (hope you understand this!)
If you have a CAB near you that has an employment specialist then take the contract to them and ask about being paid whilst suspended.
Alternatively, contact ACAS.0 -

Yes, but as I say, in the circumstances it is frankly meaningless.
That said, if they have told you they will be in touch then all you can do is assume they will and give them a few days.0 -

Probably not. The whole point of a zero hour contract is that the employer is not obliged to offer work (nor is the employee obliged to accept work offered).
Yes, in the event of a finding of unfair dismissal then any award would be based on average earnings.0 -
have you ever had a police check done to allow you to work with kids? it might be as simple as that, until you get one done and it comes back clean then they have to be cautious and not let you workmortui non mordent0

Thank you for your feedback guys. I had a meeting with HR and also my manager today. Basically a colleague has made an allegation against me of stealing (which might I add is 100% not true). It's my word against hers and I was in giving my side of the story today, will here back in due course if they believe me or not.0

Didn't believe a word I said, got a letter in telling me my context has been terminated. 4 years of hard work and all I got was 1 single paragraph not even a reason as well on my I was let go. Club had no evidence other than this girls word against mine. Looking into appealing it just now0

Did you cross examine the colleague? Were there any witnesses you coukd call to support your version of events?
Are you doing the appeal alone or do you have support from a union rep?0
